A St. Charles man has been sentenced to death for the 2018 murders of his girlfriend and her family.

A jury that consisted of two men and 10 women in their mid-20s to mid-60s found Richard Darren Emery guilty on four counts of first-degree murder on Friday, Sept. 30. The defense did not dispute the fact that Emery killed his girlfriend, Kate Kasten, her two children from a previous relationship, 10-year-old Jonathan and 8-year-old Zoe, and Kate’s mother Jane Moeckel.

Prosecutors sought the death penalty, showing traumatic police body camera footage to the jury of the aftermath.

Emery’s public defense attorneys presented a diminished capacity case to the jury, claiming he’d previously been diagnosed with borderline personality disorder and was not in control of himself at the time of the murders. They had pushed for conviction on second-degree murder in the hope of sparing Emery’s life. Emery’s family, friends, and coworkers testified to try and convince the jury to change their mind about giving him the death sentence.

The jury deliberated for a little over two hours on Tuesday, Oct. 4. The jury convicted Emery in a unanimous decision of depravity of mind, vile, callousness, and disregard for the sanctity of all life.

As Judge Michael James Fagras read each sentence aloud to the court—death on each count—Emery hung his head after learning his fate. Emery hugged his attorneys and sobbed for a few minutes after the jurors left the court

The St. Charles County Prosecuting Attorney Tim Lohmar said the jury made the right decision.

“To my left are some of the gentlemen whose body cameras captured the footage at the crime scene in the initial moments,” Lohmar said. “It was appalling for me to have to watch it the first time. It was appalling for our team to watch it dozens of times. It was even worse for these guys to have to live through it.”

That body camera footage is most likely what helped convince the jury to sentence Emery to death on all four counts of first-degree murder.

The courtroom was packed with family and friends on both sides, all filled with sorrow, shoulders shaking, and quiet sobbing.

The defense is expected to file an appeal.

At the start of the trial on Sept. 20, prosecutors said Emery wiped out three generations of one family just before midnight on Dec. 28, 2018.

Prosecutors described Emery’s actions that night as “deliberate, intentional and purposeful.” 

All four victims were shot in the face or head at close range, the prosecutor said. The murder weapon, a 9mm pistol, was so close to the victims that their skin had gunpowder burns.

Attorneys for the prosecution and defense agreed that Emery had gone out drinking and played poker earlier that evening. Emery returned home and got into an argument with Kate. At some point, Emery retrieved a handgun, and he and Kate struggled for the weapon.

Emery fired nine shots in all. Kate was the first person shot, but was the last to die. She died hours later at a local hospital.

Moeckel, Kate’s mother, barricaded herself and two grandchildren in another room in the house. After shooting Kate, Emery broke down the door to that room and shot Moeckel while she was on the phone with 911 dispatchers. Before being shot and killed, Moeckel provided dispatchers with the home address and said her daughter had been murdered. She never got a chance to identify the shooter.

The two children, Jonathan and Zoe, were the final victims to be shot.

After the shooting, Emery left the home with the pistol and an AR-15 rifle, including 500 rounds of ammunition, and a knife.

Emery drove away from the home as police arrived at the scene. That officer radioed colleagues to stop Emery’s truck.

Emery was pulled over and exchanged gunfire with police. He fired seven shots and fled. Emery suffered two gunshot wounds during the shootout. He did not take the AR-15 with him.

Prosecutors said Emery eventually came across a woman who was leaving a Christmas party. Emery, who still had his knife, carjacked the woman and attacked her. He stabbed the woman seven times, five in her chest, but ran off when the car alarm went off. The woman survived.

After his arrest, Emery asked if the police he shot at were okay. He also asked if the woman he stabbed was okay. At no point did he ask about Kate Kasten and her family, prosecutors said.

On the final day of testimony, Emery took the stand to say he was not in control of his actions but acknowledged he had killed Kate and her family, and accepted responsibility for their deaths.

The start of the trial was delayed several months after Emery’s public defender died in January 2022. Public defenders from Jefferson City represented Emery during the trial.

A Republic teenager accused of stabbing an elderly woman to death in 2016 has pleaded guilty to second-degree murder and was sentenced to life in prison.

Trystan Westrip was 16 when he killed 80-year-old Mary Shisler at her home near Strafford.

He was charged with first-degree murder, armed criminal action, first-degree tampering, and second-degree attempted arson after being certified to stand trial as an adult in 2017. Under a plea agreement, he pleaded guilty to murder in the second degree and armed criminal action. The other charges were dismissed.

On Thursday, May 12, 20222, he was sentenced to life in prison for the murder and 10 years for ACA, to be served concurrently.

According to court documents in the case, authorities went to Shisler’s home near Strafford after neighbors reported a suspicious green vehicle in Shisler’s driveway. Shisler’s vehicle was also missing.

A neighbor entered through the back door of Shisler’s home – which was open – and smelled gas accompanied by a gas heater and burner to a stove both turned on. The neighbor turned off the appliances and called the police, according to a probable cause statement.

Deputies found a bottle of lighter fluid that had been slashed as well as a match sticking up inside a wad of toilet paper. A small amount of blood was also spotted in the home.

After running the VIN number to the suspicious vehicle, deputies confirmed it belonged to Westrip, who was considered a runaway.

Missouri Highway Patrol later found Shisler’s vehicle in Marshfield where they found Trystan Westrip to be the driver.

Westrip made several comments to investigators, saying he killed an “old lady” and dragged her body into a field near her residence. He was transported to the scene and pointed where he left her body. Shisler was found dead, having suffered multiple stab wounds to her head.

During a post-Miranda interview, Trystan Westrip says he left his home on Oct. 21 after an altercation with his parents.

He says he was trying to drive to Canada but later decided his vehicle (the one found in Shisler’s driveway) would not make it that far north.

He spotted Shisler’s truck, stopped, and began speaking with Shisler, he told investigators

She offered to buy him gasoline but he refused and they began to walk to the neighbor’s house together. This is when Trystan Westrip pulled a knife out of his pocket and stabbed Shisler in the temple at least twice, the court document states.

He told investigators he then lifted her body over a fence and into a field to conceal it. Shisler was not yet dead and Westrip stabbed her seven more times in the head.

Trystan Westrip then stole items from Shisler’s residence and wished to destroy the evidence. This is when he soaked the toilet paper with gasoline and lit a match.

 A Jefferson City suspect has been charged with Second-Degree Murder and Assault in the death of one man and serious wounding of another on December 12 near Atchison Street and Broadway.

According to court documents, the victim who survived told police that he and his friend, 33-year-old Justin Kammerich, were standing outside their apartments when they were approached by a man with a Glock pistol with an extended magazine who tried to rob them. Before they could turn over their belongings, the shooter, 16-year-old Jahaun Whirley, shot them both multiple times before running away.

A witness told police that Whirley came knocking on his door the next day looking for his cell phone, which he apparently had lost sometime during the commission of the homicide. The witness said Whirley had an aggressive demeanor about him and believed his phone was at the witness’s residence.

Police searched Whirley’s residence, and found a bag containing a Glock pistol with an extended magazine and a round in the chamber. They also found clothing that matched a description given by the surviving victim. The Missouri Highway Patrol’s lab confirmed that Whirley’s gun fired the rounds found at the crime scene.

Police are seeking charges of Second-Degree Murder, Robbery, Armed Criminal Action, Assault, and other charges.

A jury recommends a sentence of life without parole for a Jefferson City teen convicted of murder.

Jahaun Whirley, 18, was found guilty Monday of seven charges including second-degree murder.

The jury’s recommendation is the same as the sentence recommended by prosecutors.

Whirley was arrested for a double shooting that took place on W. Atchison Street in Jefferson City in December 2018.   One of the men Whirley shot, 33-year-old Justin Kammerich, died from his injuries.

Whirley was 16 at the time of the shooting, but was certified to stand trial as an adult.

John Hamm has been sentenced to life without parole for the murders of his roommates. According to court documents John Hamm was involved in an argument with his two roommates, 46-year-old Robert Hall and 41-year-old Shannon Larock, over rent money when the argument turned violent. John Hamm would beat and stab his two roommates to death. Hamm had faced the death penalty early on for the double murders however that was taken off the table. Hamm argument for the double murders was that it was second degree murder and not first degree, the difference being parole eligibility, however the jury would find him guilty of two counts of first degree murder

The St. Louis Post-Dispatch reports that 48-year-old John Hamm was sentenced Friday. On Feb. 4, a jury convicted Hamm of two counts each of first-degree murder and armed criminal action, and one count of auto theft.

Police say Hamm confessed to killing 46-year-old Robert Hall and 41-year-old Shannon Larock on July 12, 2016, after an argument over rent money. The defense conceded that Hamm killed the victims, but had argued the killings were not premeditated, which is required for a first-degree murder conviction.

John Hamm, 48, was convicted Friday of two counts each of first-degree murder and armed criminal action, and one count of stealing a motor vehicle, the St. Louis County Prosecuting Attorney’s Office said in a news release.

Hamm confessed to killing Robert Hall, 46, and Shannon Larock, 41, on July 12, 2016, at a home they shared.

His attorneys conceded during the trial that Hamm killed the victims but said the deaths were not premeditated, which is required for a first-degree murder conviction.

The prosecutors argued Hamm acted with “cool deliberation” before killing the victims.

Cornelius Green has been charged with the murder of Jocelyn Peters who was pregnant at the time of her death in 2016. According to police reports Cornelius Green (above image on the left) would plan with childhood friend Phillip Cutler to murder Jocelyn Peters who became pregnant while the two were having an affair. While Phillip Cutler was murdering the pregnant school teacher Cornelius Green, a former principal, was conveniently out of town. Phillip Cutler would break into Jocelyn Peters apartment and fatally shoot her. Investigators were able to track a package that Cornelius Green used to pay Phillip Cutler. Cornelius Green who would be arrested for theft for stealing from the school he used to be a principal at. Now Cornelius Green and Phillip Cutler are facing two counts of murder and could be sentenced to death.

A federal grand jury indicted a former St. Louis principal and an Oklahoma man in a murder-for-hire plot that left a pregnant woman dead in 2016.

Cornelius Green hired his childhood friend, Phillip J. Cutler, of Oklahoma, to kill 30-year-old Jocelyn Peters in 2016, the indictment alleges. Although Green was legally married, he began dating Peters who then became pregnant. Between Feb. 29, 2016, and Oct. 11, 2016, investigators believe Green hatched his plan to kill Peters and her unborn child. Peters was a teacher at Mann Elementary in St. Louis City while Green was the former principal at Carr Lane Visual Performing Arts School

Prosecutors allege the murder was “outrageously vile, horrible or inhuman in that involved torture or depravity of mind.”

“What we have here is an apparent murder for hire,” said Jennifer Joyce, Former St. Louis Circuit Attorney. “What we do know is Mr. Green did send Mr. Cutler through the mail $2,500 cash.”

On March 7, 2016, Cutler allegedly received the money in a UPS package in Oklahoma. Court records show Cutler was visiting in St. Louis the week of Peter’s murder and stayed at one of the former principal’s homes. Green traveled to Chicago to distance himself from the murder. Seventeen days later, Cutler drove Green’s Kia Optima and broke into Peters apartment in the 4200 block of West Pine. Utilizing a potato as a silencer to muffle the sound, police said Cutler shot Peters in the head while she was in her bed. She was seven months pregnant at the time of the shooting.

Green was arrested in August 2016, on theft charges, for allegedly stealing $2,700 from a student dance group at the school where he used to be a principal. Green faces two counts of first-degree murder. Cutler was also charged with various crimes related to the murder.

In 2017, prosecutors sought the death penalty for both men.

A federal grand jury indicted Cornelius M. Green and Phillip J. Cutler on March 9, 2022, for conspiracy to commit murder for hire and murder for hire that resulted in the death of Jocelyn Peters and her unborn child in 2016.

The indictment alleges that Green and Cutler had a longstanding and close friendship and Green, already legally married to another was involved in an ongoing romantic relationship with Jocelyn Peters.  In 2015, Ms. Peters became pregnant, with Green being the father of the unborn child.

Beginning at an exact time unknown but including February 29, 2016, through October 11, 2016, within the Eastern District of Missouri and elsewhere, Green devised a plan to murder Peters and her unborn child.  Part of that plan was that Green offered cash to Cutler for the murder of Peters and her unborn child.

It is alleged on or about March 7, 2016, Green sent a package via United Parcel Service containing $2500.00 to Cutler, who accepted the package at an address in Oklahoma.  As part of the conspiracy, it is alleged that Cutler traveled to St. Louis on March 21, 2016, staying at a residence occupied by Green.  The next day, Green traveled to Chicago, Illinois allegedly to distance himself from the homicide.

It was further part of the conspiracy that on or about March 24, 2016, Cutler traveled to the area of 4236 W. Pine in Green’s 2013 Kia Optima, unlawfully entered Jocelyn Peters’ apartment, Unit #201, found Peters in her bed, shot her with a .380 caliber firearm in the head while using a potato as a silencer to muffle the sound of the shot.

Cornelius Green and Cutler were both charged for a variety of crimes related to the murder of Peters and her unborn child by the St. Louis Circuit Attorney’s Office and are currently incarcerated awaiting trial.

Charges set forth in the indictment are merely accusations and do not constitute proof of guilt.  Every defendant is presumed to be innocent unless and until proven guilty.

The case was investigated by the St. Louis Metropolitan Police Department and the Federal Bureau of Investigation.  The case is being prosecuted in cooperation with the St. Louis Circuit Attorney’s Office.
