Kendrick Simpson seemed resigned to his fate before he even heard the jury’s verdict.
The former New Orleans resident only grimaced slightly when his death sentence was announced Thursday in Oklahoma County District Court.
Simpson, 27, had wiped tears from his eyes two days earlier when he was convicted of killing two men and trying to kill a third in a Jan. 16, 2006, drive-by shooting.
Defense attorney Bill Campbell asked the jury to spare Simpson, who was forced to relocate to Oklahoma in 2005 by Hurricane Katrina, but the seven-man, five-woman jury needed less than two hours to decide the death penalty was the appropriate punishment for his crimes.
Prosecutors had argued Simpson deserved to die because he has shown no remorse for the murders of Glen Palmer, 20, and Anthony Jones, 19.
“It doesn’t bring the victims back, but it is justice,” Assistant District Attorney Steve Deutsch said Thursday in his closing argument. “Any sentence of less than death diminishes what he’s done.”Witnesses made plea dealsSimpson’s attorney contended he was the son of a single teen mother who turned to the streets when he didn’t get enough guidance from his family.
“He was a good child trying to make his way on his own,” Campbell said. “That’s not a good thing.”
He acknowledged the fatal drive-by shooting shouldn’t have happened, but he urged jurors not to sentence Simpson to death.
“There’s no point in destroying another family,” Campbell said. “There’s no reason to kill him.”
Simpson was convicted of firing as many as 25 shots from a military-style assault rifle at three men after a confrontation at an Oklahoma City night club.
The two men who were in the car with Simpson during the drive-by shooting pleaded guilty in April to being accessories to the murders. Former New Orleans residents Jonathan Dwight Dalton and Latango Wayne Robertson testified against Simpson during the nine-day trial. Both are serving 20-year prison terms.Death penaltyJurors were able to impose the death penalty against Kendrick Simpson because they concluded prosecutors proved four aggravating factors in the case:
•Simpson had a prior conviction for a violent crime.
•Simpson’s actions threatened more than one person.
•His crime was heinous, atrocious or cruel.
•Simpson poses a continuing threat to the community.
