A community in Queens, the NYPD, and a young family are all mourning the loss of Officer Jonathan Diller, who was fatally shot during a traffic stop in Queens.

Diller, 31, who lived in Massapequa Park with his wife Stephanie and nearly 1-year-old son, joined the NYPD in February 2021.

Authorities say Diller and another officer were conducting the traffic stop on Mott Avenue at around 5:45 p.m. Monday. The NYPD Critical Response Team has been focusing on cars with fake plates, illegal tints or other quality-of-life issues.

NYPD officials say the officers stopped the vehicle, which had two men inside, because it was parked at a bus stop illegally. When officers asked the individuals to step out of the vehicle, the suspect in the passenger’s seat refused, and pointed a gun at the officers.

Guy Rivera, 34, is accused of shooting Diller, who was struck in the torso, just below his bullet-resistant vest. Officials say Diller’s partner then fired at Rivera, striking him in the back

Diller was rushed to Jamaica Hospital in critical condition and later died.

The second officer was taken to the hospital with tinnitus.

The other suspect has been identified as 41-year-old Lindy Jones. A gun was recovered at the scene.

One of the men is at Jamaica Hospital, while the other is at a police precinct. No official charges have been announced.

Rivera has been arrested by the NYPD 21 times — nine of them felonies. He was released from prison in September 2021 after serving nearly five years for criminal sale of a controlled substance. He previously spent three years in state prison for a 2011 assault and was released in October 2014.

Jones has 14 prior arrests. He was arrested for second-degree criminal possession of a weapon for having a loaded firearm in Far Rockaway on April 17, 2023. He was out on $75,000 bail. He previously served 10 years in prison on 2003 attempted murder and robbery charges and was released in November 2013.

Adams called this incident a “recidivist” problem.

“Same bad people, doing bad things to good people, less than a year, he’s back on the streets with another gun,” Adams said. “The person had a total disregard for the safety of this city. I cannot say it any clearer: it is the good guys against the bad guys. And these bad guys are violent. They carry guns. And the symbol of our public safety, which is that police uniform, they have a total disregard for.”

Adams said the deadly shooting of Officer Diller is “extremely painful for this city.”

“There will be plenty of time for anger, grief and for processing pain, but right now, our prayers are with our fallen officer’s family, his fellow cops and every member of the New York City Police Department, but most of all, they’re with the officer himself,” NYPD Commissioner Edward Caban said.

Governor Kathy Hochul released a statement in response to the “‘senseless” killing.

“My prayers are with his family, loved ones and the members of the NYPD,” said Hochul. “His heroism and service will never be forgotten.”

This is the first NYPD officer killed in the line of duty since 2022, when officers Wilbert Mora and Jason Rivera were fatally shot in a Harlem apartment building after responding to a domestic disturbance call.

A wake for Diller will be held Thursday and Friday at Massapequa Funeral Home while a funeral is set for Saturday at St. Rose of Lima R.C. Church.

New York City police have named a teenage suspect wanted in the deadly shooting on a train that killed an innocent bystander and injured several other people during a gang dispute.

The NYPD released an image of Maurice Stewart over the weekend. Investigators said he was connected to the deadly shootout between rival gangs on a #4 train at the Mount Eden station in the Bronx last week.

“Thou shalt not kill – please take a look at this flyer. On Monday, February 12, during rush hour, this person opened fire on the subway killing a New Yorker,” NYPD Deputy Commissioner Kaz Daughtry posted on X. “We need your assistance. Help us keep our transit system safe.”

Meanwhile, a 16-year-old boy has been charged with murder and five counts of attempted murder, Fox New York reported.

The first shots were fired as the train pulled into the elevated Bronx station shortly before 5 p.m. and continued on the crowded platform as passengers fled. Investigators found 19 shell casings, three of which were found inside a subway car.

A man, identified as Obed Beltran-Sanchez, 35, died after being shot in the chest. The five other people wounded ranged in age from 14 to 71.

The NYPD says 15-year-old Maurice Stewart is wanted in connection to the shooting.

Police have named the suspected teenage killer in a Bronx subway shootout, and they want help tracking him down.

Investigators say Maurice Stewart, 15, fired the shot that killed a 35-year-old man on the platform at the Mount Eden Station on Monday.

The shooting injured five other people, including a 14-year-old, who police believe was another shooter.

Police also charged a 16-year-old.

35-year-old Obed Beltran-Sanchez, was killed.

“One bullet hit him in the chest. He died almost immediately,” said Jorge Islas, Consul General of Mexico in New York. “And with that, that bullet, life on a dream, someone who was willing to do something important for his family.”

Islas says Beltran-Sanchez left behind a wife and two young daughters. It is believed he was a migrant from Mexico who crossed the border from Canada in search of construction work as a day laborer.

“He can buy a little house for his family. And he was willing to work hard in American New York, and over time, retire and go back to Mexico to work on Puebla and eventually live in the house that he was willing to build,” Islas said.

According to police reports the unnamed fourteen year old teen was asking Colin McNally for a basketball and then attempted to grab the ball. A teacher at a high school in Queens is facing charges and accused of slamming a student into the walls and then tossing him to the ground.

Police made the arrest on the school grounds of Cardozo High School after being called to the scene.

Video obtained by Eyewitness News shows the unsettling altercation inside the school involving teacher Colin McNally as he roughed up a 14-year-old student.

It happened Wednesday around 11:15 a.m. and now police and the Department of Education are both now looking into the incident.

Officials say the student had just finished playing basketball in the gym. McNally took the ball from the teen and was heading to the dean’s office.

The student appeared to try and get it back, when out of nowhere, McNally grabbed him by the shirt and slammed him against the wall before tossing him to the ground.

On Thursday many students were talking about the incident. It lasted just 16 seconds but the fallout is huge.

McNally, who teaches PE and is a coach for Varsity Boys tennis, was arrested and charged with harassment and endangering the welfare of a child. He has since been released.

A spokesperson for the DOE said:

“These are incredibly disturbing allegations, and Mr. McNally was immediately removed from the classroom away from students, pending the outcome of the investigation.”

The student was not hurt. Eyewitness News reached out to McNally for a statement but he did not respond.

Months before the murder of John Lennon his murderer, Mark David Chapman, who had been a huge fan of The Beatles was not happy with the musician as he felt that Lennon’s remarks about The Beatles being more popular than Jesus plus his lyrics in his music since leaving The Beatles. Mark David Chapman who identified with the character Holden Caufield from JD Salinger’s novel The Catcher In The Rye began to plan on killing John Lennon.

Mark David Chapman would fly to New York City on December 6 1980. Once he was in the city he would buy another copy of The Catcher In The Rye which he would write “This Is My Statement” and signed it Holden Caufield. Police would find the book in his hotel room at the Sheraton Hotel after the murder.

Mark David Chapman was at the Lennon residence at The Dakota earlier in the day and spent time talking with other fans. Chapman would actually shake hands with Sean Lennon who was then only five years old. Chapman would be distracted and would miss seeing John Lennon that morning.

At 5:00 pm John Lennon and Yoko Ono would return to their residence and Lennon would sign autographs for fans including Mark David Chapman who would later describe the meeting as “He was very kind to me. Ironically, very kind and was very patient with me. The limousine was waiting … and he took his time with me and he got the pen going and he signed my album. He asked me if I needed anything else. I said, ‘No. No sir.’ And he walked away. Very cordial and decent man.”

At approximately 10:50 pm John Lennon would arrive back at his residence at The Dakota after spending a few hours recording. The doorman began to walk up to Lennon’s limousine. Yoko Ono would walk past Mark David Chapman who he nodded at. When John Lennon walked past Chapman he appeared to recognize him from earlier in the day.

Mark David Chapman would pull out a .38 caliber handgun and would shoot John Lennon with four hollow point bullets. John Lennon would be loaded into a police car and rushed to the hospital where he was announced dead on arrival. he was forty years old

Mark David Chapman would take off his jacket and sit down on the sidewalk. Police would find him reading another copy of The Catcher In The Rye.

Mark David Chapman would undergo over two hundred hours of testing and was declared competent. The defense team planned on calling a ton of witnesses to dispute the mental well being of Chapman however Mark would change his plea and would plead guilty to second degree murder.

Mark David Chapman would be sentenced to twenty years to life. Since being eligible for parole in 2000 Chapman has been turned down eleven times.

Mark David Chapman, who murdered John Lennon outside his New York apartment in 1980, has been denied parole for the 11th time. A parole board at Wende correctional facility near Buffalo, New York, denied Chapman’s release, though detailed reasons have not been given. He will have to wait two years before applying for parole again.

Lennon’s wife, Yoko Ono, who was with him when he was shot four times by Chapman, has long opposed parole, and submitted comments to the parole board that were “consistent with the prior letters”, according to her lawyer Jonas Herbsman. Chapman was sentenced to 20 years to life imprisonment, and first became eligible for parole in 2000.

In 2018, he spoke of an internal “tug of war” over whether to carry out the killing, which he did hours after he had met Lennon and got a record autographed. “I was too far in,” he said. “I do remember having the thought of, ‘Hey, you have got the album now. Look at this, he signed it, just go home.’ But there was no way I was just going to go home.”

Chapman is religious and has said he would like to work with a minister if he was released. He is still married to his wife, Gloria, following their marriage 18 months before the Lennon killing.
