U.S. District Judge Susan Paradise Baxter ordered a stay of execution Tuesday until Jordan Clemons’ case is completed in federal court.

A Washington County jury in 2015 found Clemons, who turned 31 Monday, guilty of planning and carrying out the murder of his estranged girlfriend, Karissa Kunco, 21, of Baldwin Borough in Pittsburgh’s South Hills.

Her body was found in Mt. Pleasant Township, Washington County, in January 2012. Her throat had been slit.

Pennsylvania Department of Corrections Secretary John Wetzel signed a notice of execution for Clemons Monday, scheduling the death sentence to be carried out March 13.

Clemons’ initiated a federal case Nov. 27. Assistant federal public defenders Ryan N. Norwood and Kirk J. Henderson were assigned to his case last month. They immediately requested the stay of execution.

Baxter’s order was served Tuesday on Wetzel, plus Washington County District Attorney Gene Vittone; Robert Gilmore, superintendent of SCI-Greene, where Clemons is incarcerated; and Mark Garman, superintendent of SCI-Rockview, the designated institution where a lethal injection would theoretically be carried out.

Gov. Tom Wolf, however, declared a moratorium on death penalties shortly after taking office, and Pennsylvania has not executed a prisoner since 1999.

After the state Supreme Court upheld his conviction, Clemons’ case went to the U.S. Supreme Court, which declined to review it last year.

On Clemons’ behalf, Norwood and Henderson initiated habeas corpus proceedings in federal court, Pittsburgh, which allows a petitioner to raise issues outside of those already appealed.

Karissa’s father Paul Kunco, of Baldwin, said that this stay is “what we had expected.” He said Vittone has kept his family abreast of developments in the case.

Karissa’s sister, Kayla Mihelcic of Pittsburgh, also said the decision was expected and that she will “push forward.”

“We knew that would be the outcome and still feel the same way,” she said in a statement. “As long as he’s behind bars he is not a factor in our life, and we refuse to give him any more attention. She is and always will be my only sister. As it was my responsibility as a big sister to fight for her life, it still is as in her death. Clemons has not broken me nor the bond that Karissa and I have always had.”

On Monday, Pennsylvania Department of Corrections Secretary John Wetzel signed a Notice of Execution for a Bristol Township man who was found guilty of killing a pregnant woman and her 4-year-old daughter.

The notice set May 7 as the date of execution for 24-year-old Marcel Johnson. He was convicted in 2015 and has since tried to appeal his case.

Corrections officials noted that the execution notice was issued by Wetzel because Gov. Tom Wolf did not sign a warrant of execution. The secretary’s notice was issued because Wolf did not sign the warrant within a certain period of time.

Wolf has placed a moratorium on the death penalty in Pennsylvania. While criminals can be sentenced to death, Wolf will not sign warrants for their execution. However, that could change when a new governor takes office.

Johnson was convicted in June 2015 for the November 2013 incident that led to the sentence of death for the murder of R’mani Rankins, 4, and life in prison for the killing of five-months pregnant Ebony Talley, 22.

Prosecutors made the case that Johnson, who had a troubled childhood, killed Talley, her unborn child, and little R’Mani inside a subletted apartment at the Avalon Court complex on Bristol-Oxford Valley Road in Bristol Township. In a failed effort to hide his crimes, he set fire to the apartment and fled the scene in a vehicle that a witness spotted.

Sources told LevittownNow.com at the time that both Talley and Johnson were involved in the Lower Bucks County drug trade. During the trial, it was revealed that bags similar to those used to package heroin – labeled “#1 way to go” – were found near Talley’s body, and the prosecution argued Johnson wanted more of her business.

A deputy coroner said Talley was stabbed around 30 times before the arson fire. Talley’s womb was punctured and the male fetus inside died due to his mother’s injuries. The little girl was rushed by first responders to the hospital but died from a large stab wound on her upper chest. She also suffered third-degree burns on her stomach, according to testimony.

The 24-year-old man joins former Bucks County residents Frank Chester (1989), Robert Diamond (2009), Robert Flor (2006), Richard Laird (1989) and Alfonso Sanchez (2008) on death row.

Statewide, there are 150 prisoners on death row in Pennsylvania.

Johnson’s brother, Montel, is in state prison for 20 to 40 years for his role in a botched robbery that led to the death of a family pet.

Pennsylvania corrections officials signed a notice of execution Tuesday for a man sentenced to die for the killings of two Vietnamese brothers whose bodies were found bound, tortured, and tossed in the Schuylkill in 2014.

But that doesn’t necessarily mean Tam Minh Le, 49, will be put to death any time soon.

Gov. Tom Wolf, who has the authority to block executions, declared a moratorium on capital punishment shortly after taking office in 2015 and has vowed to block all executions pending legislative action to address shortcomings of the state’s death-penalty law.

The last person executed in Pennsylvania was Gary Heidnik, who was put to death in 1999 for torturing and murdering two women in his Philadelphia basement.

The execution notice for Le, signed Tuesday by Department of Corrections Secretary John Wetzel, was issued under a provision of the law that requires him to issue such orders when the governor fails to sign a warrant of execution during a given time period.

Wetzel’s notice scheduled Le’s execution for June 2.

A jury sentenced Le, a reputed Vietnamese gang member, to death after a trial in Philadelphia in which prosecutors alleged he and others had killed brothers Vu “Kevin” Huynh, 31, and Viet Huynh, 28, over a $300,000 drug debt they owed their marijuana supplier in California.

Since then, federal authorities have alleged that Le lured the brothers to his home under orders from a onetime ranking member of the New York City-based Vietnamese gang known as “Born to Kill,” after a slogan painted on helmets of some U.S. soldiers during the Vietnam War.

According to a third man who survived the attack, the Huynhs were stripped to their underwear and tortured for hours before being stabbed multiple times and dumped in the river.

Federal prosecutors have charged six other suspects who they say either enlisted Le or assisted him in carrying out the slayings and eluding capture.

Le is being held at a state prison in Greene County near the state’s border with West Virginia.

Pennsylvania has scheduled June 22 for the death of Eric Frein, the Monroe County man who ambushed and killed a state trooper in 2014, though the state has a moratorium on capital punishment.

Corrections Secretary John Wetzel signed a notice of execution Monday for Frein, 36, of Canadensis.

However, Gov. Tom Wolf’s death penalty moratorium, enacted in 2015, remains in effect. The moratorium does not halt death warrants from being issued. Defendants must seek a stay of the warrant.

Pennsylvania has executed three inmates since reinstating the death penalty in 1976. The most recent execution was in 1999.

Pennsylvania Department of Corrections Secretary John Wetzel signed a Notice of Execution Thursday for a Lancaster County man on Death Row for stabbing two women to death in 2015.

Leeton Jahwanza Thomas was convicted of murdering Lisa Scheetz and her 16-year-old daughter, Hailey, in their East Drumonre Township, Lancaster County home on June 11, 2015

Thomas also stabbed Scheetz’s 15-year-old daughter, severely injuring her. He was convicted of attempted murder for that offense.

Thomas’ execution date is July 28, 2020. 

Governor Tom Wolf declared a moratorium on the death penalty in Pennsylvania in February 2015, saying the system can sometimes claim innocent lives, does not always work as a deterrent to crime, can be racially biased, costs a lot of money, and disregards mental illness in the US. 

That moratorium remains in effect today, though capital crimes are still prosecuted and death warrants still signed.

Pennsylvania has not executed an inmate since 1999.
