The two would get in a vehicle together and would drive to a reservation where Aaron Gunches shot the victim twice in the head. Aaron Gunches was later involved in a high speed police pursuit and when the Officer approached his vehicle afterwards Gunches would fire two bullets at him. Thankfully the Officer bulletproof vest stopped on of the shots and the second shot deflected off of his watch. In December of 2002, the body of Ted Price was found shot to death on the Salt River Reservation near Mesa. In January of 2003 Gunches was pulled over by Arizona DPS Officer Robert Flannery near the California border. Gunches shot Flannery twice – luckily, one of the bullets was stopped by a bulletproof vest and the other deflected off Flannery’s wristwatch and he suffered minor injuries. Gunches fled and ultimately was arrested after a manhunt that included more than 50 officers. Bullet casings found near Price’s body matched the gun Gunches used to shoot Officer Flannery. Gunches pled guilty to the execution-style murder of Ted Price. At the penalty phase, Jennifer Garcia testified that she and Gunches were staying with Gunches’ girlfriend in Mesa when Price, who was the girlfriend’s ex-husband, came to visit. Gunches grew angry at Price and ordered Garcia to drive him and Price out to the reservation, where Gunches shot Price three times in the chest and once in the back of the head.

In November 2002, Ted Price visited his ex-wife, Katherine Lecher, in Mesa, Arizona. Price planned to stay at Lecher’s apartment while waiting for a school grant. After about ten days, the two began fighting and Lecher told Price to leave. The argument became increasingly heated and Lecher hit Price in the face with a telephone. Price remained conscious but appeared dazed and unresponsive.

¶ 3 Gunches came to the apartment that evening. After talking with Lecher, he asked her two roommates, Michelle Beck and Jennifer Garcia, to put Price and his belongings into Lecher’s car so Gunches could take him to the bus station. Gunches told Garcia to drive. Once at the station, Gunches said he did not have enough money for a bus ticket. He ordered Garcia to drive out of Mesa. Soon thereafter, he told her to turn onto a dirt path and to drive toward a dark, isolated desert area.

¶ 4 Garcia stopped the car. While Gunches was looking in the trunk, Price got out. Garcia then heard three popping sounds and saw Price fall to the ground; after hearing another popping sound, she saw Gunches standing by Price’s body with a gun at his side. Gunches got into the car, and Garcia drove back to Mesa, stopping once to dispose of Price’s belongings in a dumpster.

¶ 5 Price’s body was discovered several days later. After Price was identified, detectives interviewed Lecher, Beck, and Garcia. Beck said that Gunches told her that he had killed Price. While the investigation continued, Gunches was arrested in La Paz County for shooting at a law enforcement officer. He later pleaded guilty to attempted murder for that incident. The authorities matched the weapon used in the La Paz County shooting with projectiles recovered from Price’s body and projectiles and a shell casing recovered from the murder scene.

¶ 6 In October 2003, Gunches was indicted for the first degree murder and kidnapping of Price. Gunches was found competent to stand trial in November 2005 and competent to waive his right to counsel in November 2007. He subsequently pleaded guilty to both counts. Based on the La Paz County conviction, Gunches stipulated during the aggravation phase that he had previously been convicted of a serious offense under A.R.S. § 13-751(F)(2) (2010). The jury also found that Price’s murder was committed in an especially heinous or depraved manner, see id. § 13-751(F)(6). Gunches presented virtually no mitigation evidence during the penalty phase (an objection was sustained to the only question he asked his one mitigation witness), but requested leniency in allocution. The jury determined that he should be sentenced to death.

The Kansas Supreme Court on Friday upheld the capital murder conviction and death sentence of Scott Cheever, who was convicted of gunning down Greenwood County Sheriff Matt Samuels during a drug raid in 2005.

In a 52-page opinion penned by Justice Eric Rosen, the state’s high court rejected Cheever’s claims that errors occurred during the guilty-phase of his trial.

The court in the ruling also identified four errors — including improper comments made and the district court judge’s instructions to jurors — that occurred during the sentencing phase of Cheever’s trial. But the court said none, considered alone or collectively, reached the threshold required to throw out his death sentence.

“In light of the record as a whole, the total effect of these errors had very little, if any, likelihood of changing the jury’s ultimate conclusion that death was the appropriate sentence,” Rosen wrote.

Cheever claimed jurors who decided his fate weren’t told mitigating factors — which seek leniency in sentencing — presented in the penalty phase of a trial needn’t be proven beyond a reasonable doubt to be used in the weighing process. In death penalty cases, a jury hears evidence both in support of execution and against it, and then decides which carries greater weight.

He also claimed a prosecutor unfairly harmed his chances at life imprisonment when he told jurors they should reject requests for leniency on the basis of Cheever’s methamphetamine use.

The court expressed disapproval at the remark in Friday’s ruling, but said that the error was harmless.

The decision to uphold Cheever’s death sentence was 6-1.

On May 10, 2005, Officer David Uribe – a 22-year veteran of the Phoenix Police Force, conducted a license plate check on a vehicle while driving on I-17. The result of the check indicated the vehicle was stolen. He pulled the vehicle over near the intersection of Cactus Road and 31st Avenue. Delahanty was in the passenger seat; Christopher Wilson was the driver, and a third man was sitting in the back seat. According to testimony presented at trial, Wilson handed his gun to Delahanty in an effort to conceal it from Officer Uribe. Officer Uribe then came to the driver’s window and asked Wilson to turn the car off and also for his driver’s license. Delahanty instantly lunged over Wilson and shot Officer Uribe three times, striking him in the head, face, and neck. Wilson sped away and the three men abandoned the vehicle a few blocks down the road. Delahanty and Wilson were arrested two days later. Wilson plead guilty to second-degree murder and testified against Delahanty at trial.

On May 10, 2005, Delahanty shot Phoenix Police Officer David Uribe three times in the head and neck, killing him.   Officer Uribe, driving a marked patrol car, had stopped a car driven by Christopher Wilson.   Delahanty was in the front passenger seat of the car and John Armendariz sat in the back seat.   As Wilson sped from the scene, Delahanty said “I just shot a cop”;  “we got to burn the car.”   After Wilson stopped the car, Delahanty unsuccessfully attempted to destroy it by shooting its gas tank.

¶ 3 Delahanty and Wilson were charged with first degree murder.   Wilson pleaded guilty to second degree murder and testified against Delahanty.   While awaiting trial, Delahanty sent letters to a girlfriend seeking to have Wilson and Wilson’s mother killed.

¶ 4 After conviction, Delahanty and the State waived a jury trial on aggravation.   The trial judge found that Delahanty had been convicted of serious offenses committed on the same occasion as the homicide, A.R.S. § 13–751(F)(2), and that the victim was a peace officer killed while performing official duties, A.R.S. § 13–751(F)(10).

¶ 5 Shortly after the penalty phase began, Delahanty sought to waive presentation of mitigation.   The trial judge appointed Dr. Bruce Kushner, a psychologist, to determine whether Delahanty was competent to do so.   After receiving Dr. Kushner’s report, the court concluded that Delahanty had knowingly, intelligently, and voluntarily waived his right to present mitigation.   The jury subsequently determined that Delahanty should be sentenced to death.

On May 26, 2003, Cruz murdered Officer Patrick Hardesty, an on-duty law enforcement officer with the Tucson Police Department. Officer Hardesty had responded to a traffic collision in which Cruz’s vehicle struck another vehicle. Cruz fled the scene and Officer Hardesty and other officers located him inside a nearby apartment. Cruz told the Officers that his name was Frank White and led the Officers to a vehicle parked outside the apartment complex to get identification. Instead of producing his identification, Cruz escaped, sneaking through a hole in a fence right next to the apartments. Officer Hardesty began chasing Cruz on foot while another officer ran back to his police car and drove in the direction that Officer Hardesty was chasing Cruz. Cruz shot and killed Officer Hardesty before the other officers arrived. Cruz fired four shots, including shots to the head and adbomen, from point-blank range.

A Tucson jury has found John Montenegro Cruz guilty of first-degree murder in the shooting death of Tucson police officer Patrick Hardesty.  Prosecutors are seeking the death penalty.

Cruz showed very little emotion when the verdict was read Friday afternoon. It took jurors less than three hours to reach a guilty verdict. They deliberated for one hour Thursday and just over an hour Friday.

With 92 potential witnesses, and three weeks in the courtroom, jurors were convinced Cruz shot and killed Officer Hardesty.  Nobody actually saw the shooting, but prosecutors linked him to the murder weapon.

“It didn’t surprise me,” said Hardesty’s brother Ed.  “I expected the verdict. I sat through all the testimony. So there’s no doubt in my mind John Cruz is guilty.”

Other Tucson officers say they’re relieved, including the detective who was a key prosecution witness and the first person on the scene the day Hardesty died.

“Even with what they described as a mountain of evidence, there’s still in the back of your mind some concern the jury understands what happened that day, and they did,” said Det. Benjamin Waters.

Police Chief Richard Miranda praised prosecutors.  He also said the trial took its emotional toll on officers.  “It’s been almost two years since Patrick was killed and with time, your feelings get a little better in terms of him dying.  But the last few weeks with the trial, we had to relieve those emotions. We’ve all had flashbacks to that day. We all had to relive the burial.”

The trial now moves into the punishment phase.  Jurors will have to consider several factors in determining whether Cruz should get a death sentence.  The jury has already decided on one aggravating factor:  Officer Hardesty was gunned down in the line of duty.  The defense will present mitigating factors against a death sentence; it plans to call as many as 15 witnesses when the sentencing phase begins next Tuesday.  Those witnesses could include family, friends, and psychiatric experts. The defense will have to prove by a preponderance of the evidence — meaning more evidence than the prosecution — that Cruz does not deserve to die.

A judge sentenced Jonathan Renfro to death for the murder of Coeur d’Alene Police Sergeant Greg Moore back in 2015.

He was sentenced to death for the first degree murder charge, then also life without parole plus 19 years for other non-capital offenses.

A jury decided Renfro should receive the death penalty on Saturday after a lengthy trial. Renfro was found guilty of murder for Moore’s death back on October 13.

In May 2015, Moore stopped Jonathan Renfro while walking through a Coeur d’Alene neighborhood that had become the victim of recent car burglaries. Investigators said Renfro pulled out a gun, shot Moore, took the officer’s gun and then sped off in his car.

Monday, there was very limited seating in the courtroom for Renfro’s sentencing. Officers from the Coeur d’Alene Police Department and Moore’s family filled the seats.
