Authorities have made an arrest in connection with the violent murder of Mildred McKinney, a 73-year-old woman who was slain in her Central Texas home in 1980.

Steven Alan Thomas, 53, was arrested Monday and accused of capital murder. The crime has haunted residents of Southwestern Williamson County for nearly 32 years.

When police notified the victim’s family, telling them that DNA testing had finally found a suspect in their loved ones brutal homicide, there were mixed feelings. McKinney’s grandson, Bob Stapleton, said the family is happy that an arrest was finally made but are sad it came a little too late.

“My family and I are very grateful with this unexpected news — news which comes bittersweet that it was not realized before the passing of first our father and then our mother over the last year and a half,” Stapleton, son of McKinney’s daughter, Patricia Stapleton, said in a statement issued through the sheriff’s office.

“But it does not alter our sincere gratitude to the Williamson County Sheriff’s Office … Without their resolve, their determination, and their passion for this cold case we may have never known closure to my grandmother’s story. She was a glorious woman who my family and I love and cherish and who will continue to live on in our fondest memories.”

McKinney’s homicide occurred on Nov. 4, 1980, at her Sherbourne Street residence, in what was then an unincorporated area of Williamson County and is now a part of Austin. McKinney’s daughter found her mother on a bedroom floor. According to police, McKinney had been “beaten, tied, sexually assaulted and strangled to death.”

In 2010, Patricia Stapleton, then in her seventies, gave one of her last interviews to KXAN before she died in 2011. She described how the walls of her mother’s home had been covered in blood and how a table and vacuum cleaner had been stacked on her mother’s body.

“I started looking around the house and I got to the bedroom and I could see my mother’s legs hanging out from the bathroom,” Stapleton said. “She was half in and half out.”

Police had no immediate suspects, but the case did gain national media attention in the mid-1980s when convicted killer Henry Lee Lucas — a man considered one of America’s most prolific serial killers — confessed to killing McKinney. But, DNA evidence later proved Lucas was not responsible for the crime.

There were local rumors and speculation that McKinney’s slaying might be linked to the Aug. 13, 1986 slaying of 31-year-old Christine Morton in her Round Rock home. The two women lived about 12 miles apart and both had been beaten to death with a blunt object. In 1987, Morton’s husband, Michael Morton, was convicted of killing her and sentenced to life in prison. He always maintained his innocence and, at 57-years-old, he was released last year after 25 years behind bars. DNA has allegedly linked 58-year-old Mark Norwood to the killing. Norwood is awaiting trial.

The first break in McKinney’s unsolved homicide happened on June 27, when the Williamson County Sheriff’s Office was contacted by the Texas Department of Public Safety Crime Lab. Officials notified the law enforcement agency that DNA from a federal database had allegedly linked Thomas, formerly of Garland, TX, to McKinney’s murder.

Sheriff’s officials interviewed Thomas twice — once in Dallas and once at his parents’ home in Austin. According to Sgt. John Foster, Thomas gave a saliva sample, but denied knowing the victim.

“Thomas stated that he never had sexual intercourse with her and didn’t recognize her home. He also denied sexually assaulting and murdering her,” Foster said.

On July 21, detectives were notified by the crime lab that Thomas’ saliva sample was allegedly a match to DNA evidence found at the McKinney murder scene. Further analysis had also determined that a latent fingerprint print from the scene of the murder belonged to Thomas, police said.

Authorities are not yet saying why Thomas, a self-employed carpenter, had his DNA in a federal database. According to Foster, investigators are not releasing any more details at this time because they want to “protect the integrity of the case and future prosecution of Steven Thomas.”

Thomas was arrested Monday by the Williamson County Sheriff’s Office and members from the Lone Star Fugitive Task Force. He was charged with capital murder in the rape and strangulation of Mildred McKinney and was ordered held at the Williamson County Jail on a $1.5 million bond. The man who assassinated Kaufman County District Attorney Mike McLelland and his wife, Cynthia, is seeking a new trial.

Eric Williams received a death sentence for Cynthia McLelland’s murder. He was also charged for the murder of county prosecutor Mark Hasse in what prosecutors argued was a case of violent revenge. The murders and the trial captured national attention.

The judge has reserved time for the proceeding to go on, if necessary, through the end of the week. Monday’s testimony came from attorneys involved in prosecuting Williams.                     

Wearing a striped prison jumpsuit and appearing with a full beard, Williams, a death row convicted killer, was escorted into court on Monday.

With his appellate team led by attorney Carlotta Lepingwell, Williams is trying to convince the judge he deserves a new trial or a new penalty phase for his conviction.

In 2013, Williams, a former justice of the peace, was arrested for three murders that rocked Kaufman County. The ambush and execution-style killing of Kaufman County prosecutor Mark Hasse happened not far from the county courthouse.  Mike and Cynthia were found shot to death inside their home.

Williams was convicted in December 2014 for Cynthia’s murder.

At the hearing, Williams hopes to convince the judge his trial defense counsel was ineffective and that there was prosecutorial misconduct, including a secret deal with his wife at the time, Kim Williams, whose damaging testimony against him was key in his conviction.

Public defender John Wright was on Willliams’ trial defense team and took the stand. During Q&A, one of his responses was: “we might’ve reviewed a quarter of the discovery. We couldn’t read it fast enough. We were just not prepared for trial.”

Attorney Lalon Peale was on Kim’s defense team and was also questioned under oath.

During the state’s cross-exam, prosecutor Lisa Smith asked, “When did the state offer Mrs. Williams a deal?”

“Right after the Eric Williams trial,” Peal answered.

And she was offered 40 years. Did you think that was fair?” Smith asked.

“Yes,” Peale replied.

The hearing will continue Tuesday morning.

A convicted College Station killer’s death row sentence is being looked at again by the Texas Court of Criminal Appeals.

In 2015, Gabriel Hall was convicted of murdering Edwin Shaar and brutally attacking his wife Linda at their College Station home. Hall was a high school student at the time and confessed to police he committed the crimes.

Defense Attorneys for Gabriel Hall are taking issue with a video the Brazos County jury was shown before he was sentenced to death. It involves an interview with comedian Jeff Ross.

Ross interviewed Hall and other inmates inside the Brazos County Jail for a TV program in 2015. Ross is known for roasting people, including celebrities with his comedy.

“I think it is a cause for concern. I think it is an issue that jeopardizes the punishment in this case,” said Shane Phelps, a local defense attorney, and former prosecutor. Phelps also serves at KBTX’s Legal Analyst.

“Prosecutors have to make a very difficult decision when they’re considering putting on evidence that is kind of novel like this evidence certainly was,” said Phelps. “They have to make a determination as to whether they think they really need it and perhaps, in this case, they thought they really needed it,” he said.

Phelps said the appeals court will look at if showing the footage was relevant.

Attorneys for Hall also said in their court filing the defense team wasn’t notified about the interview for the comedy show, which was used against him at trial.

“Did you really gain what you hoped to gain that you wouldn’t have already been able to argue to the jury?” said Phelps.

The Brazos County Sheriff’s Office allowed the comedian and camera crew inside their jail as part of an entertainment program for the inmates.

“I’m well aware of the appeal that the Hall defense has put up and I really cannot comment on that,” said Brazos County Sheriff Chris Kirk.

He did share more details on the intentions of the program.

“It was part of our inmate behavior management program where we encourage good behavior from the second they walk into the jail and in this case for a month prior to the event they had to exhibit good behavior and then personally request to be included in the show,” explained Kirk.

The sheriff said Hall and the inmates signed waivers to be in the program. Kirk said Ross wasn’t directed to talk to Hall, but after they became aware of the recording, they contacted the TV crew.

“Once we learned that we asked the producers not to use that in the show and they agreed not to,” said Kirk.

KBTX also asked the sheriff if they would change their procedures if another program like this wanted to work with them.

“You know if we had this opportunity again we would jump on it was as far as we’re concerned a success,” he replied. “It accomplished what we set out to do to and that is to encourage good behavior within our jail,” he said.

“I think the court of criminal appeals is going to struggle over this case. I think there’s probably a chance that it’ll be reversed on punishment,” said Phelps.

Legal experts said a decision on the appeal could take six to eight months.

The Brazos County District Attorney told KBTX Monday he couldn’t do an interview or make comments because the appeal is still pending.

Jurors have reached a decision in the sentencing phase of the James Calvert Capital Murder trial.

Calvert has been sentenced to death for the for the 2012 shooting death of his ex-wife Jelena Sriraman.

Jurors took just over an hour of deliberations before reaching a decision.

Calvert is the seventh person from Smith County to be sentenced to death, according to the Texas Department of Criminal Justice.

Calvert was found guilty last week by the Smith County Jury.

The manhunt for a convicted sexual predator James Paul Calvert in Rusk County has brought up painful memories of another convicted felon in East Texas.

James Calvert is on the state’s death row after being convicted in the 2012 murder of his ex-wife.

On Halloween of that year, Calvert gunned down Jelena Sriraman outside her Tyler home before kidnapping their young son. He was eventually arrested in Louisiana.

Calvert’s 2015 trial is known as one of the strangest in the city’s history. Calvert represented himself throughout the entirety of his case. One of the more memorable notes about the trial was the high number of objections brought up by Calvert.

In addition, Calvert’s children were ordered to testify during the trial by the judge.

Calvert was convicted in October of that year and sentenced to death. He remains on death row at the TDJC Polunsky Unit.

After a lengthy capital murder trial in October and a separate trial this month to address his competency, Mark Anthony Gonzalez was sentenced to death Friday morning by 175th District Court Judge Mary Roman.

Gonzalez showed no emotion as Roman said, “You are hereby sentenced, in accordance with Texas law, to death.”

Gonzalez was convicted of capital murder in the May, 28 2011, ambush-style shooting death of Bexar County sheriff’s Deputy Kenneth Vann. He was killed by a volley of shots from an assault rifle as he waited for a traffic signal at a South East San Antonio intersection.

Gonzalez’s formal sentencing was delayed until Friday pending completion of a competency trial in which Gonzalez was found competent.

In her victim impact statement delivered in court following Gonzalez’s sentencing, Vann’s widow spoke of her loss.

“I miss my husband,” Yvonne Vann said. “Every single day, I miss him.”

“I will never have any more alone time with my husband,” she said as her voice trembled with emotion. “And my time now is truly alone in every sense of the word.”

Asked if she could forgive her husband’s killer, Vann said, “To me, this is just unforgiveable, and in my heart and in my mind, it will never be forgivable.”

Gonzalez’s attorney Paul Goeke said that his client would file an appeal to the verdict in addition to appeals that automatically accompany a death sentence.
