One of the victims of a New York man who pleaded guilty to raping and sexually abusing four teenage girls and was sentenced to just eight years of probation has a warning: “He will offend again.”

Christopher Belter, 20, was facing up to eight years in jail after pleading guilty to third-degree rape, attempted sexual abuse and two counts of second-degree sexual abuse, but Niagara County Judge Matthew Murphy sentenced him to eight years of probation because he thought “incarceration isn’t appropriate.”

“I’m not ashamed to say that I actually prayed over what is the appropriate sentence in this case because there was great pain. There was great harm. There were multiple crimes committed in the case,” Murphy said, according to WKBW. “It seems to me that a sentence that involves incarceration or partial incarceration isn’t appropriate, so I am going to sentence you to probation.”

Belter must also register as a sex offender.

One of the victims – identified as MM in court filings – ran out of the courtroom and threw up after hearing the sentence.

“I completely broke down. It was as if I was being victimized all over again,” she told CBS News.

She said probation was an invitation for Belter to rape again.

“It’s just going to make him more comfortable doing this in the future,” MM said. “This is a pattern. He will offend again.”

She was 16 years old when Belter, 17 at the time, assaulted her and three other teenage girls during parties at his home in an upscale neighborhood of Lewiston, New York.

Belter’s home was allegedly dubbed the “party house” because of the liberal use of marijuana, alcohol, and Adderall, according to the Washington Post and New York Times.

The assaults took place over a 19-month period between February 2017 and August 2018, according to authorities. 

MM also dismissed claims by Belter’s attorneys that he was remorseful.

“I don’t believe it for one second,” she told CBS News. “He was saying whatever it takes for him to get his best outcome and it worked. … I will have to live with this for the rest of my life, knowing that he’s walking the streets and that another girl can be a victim of his any day now. It’s terrifying.”

She told the station that she still has nightmares about what happened and will need extensive therapy.

“I don’t think any of the victims or myself will find that closure until we know that he’s locked up, and the judge failed us there. He victimized us all over again. He is putting us through hell.”

She said the sentencing could discourage other victims of sexual assault from coming forward and testifying.

“If I were to be someone viewing this right now, looking at this case as a victim of rape or sexual assault – I mean, I would think what’s the point in coming forward?” she said. “Why put yourself through the painful experience if testifying when there’s not going to be a good outcome?”

Belter is due back in court on Dec. 3, for a hearing on his sex offender classification status.

Murphy plans to retire next month when he turns 70, the mandatory retirement age for judges in New York. But he is now facing calls to resign immediately.

John Bellocchio, part of the Survivors Network of those Abused by Priests (SNAP) filed a complaint against Murphy, according to WKBW.

“I think the judge could restore some faith in the justice system if he chose today as his last day,” Bellocchio said, according to the station. “The purpose of our court system is to be equitable and fair, and to make sure the punishment fits the crime.”

Former YouTuber and musician Austin Jones has been sentenced to 10 years in prison “for enticing several underage girls, some as young as 14 years old, to produce sexually explicit videos of themselves,” the Justice Department said. 

In February, 26-year-old Jones, who is from Bloomingdale, Illinois, pleaded guilty to receiving child pornography, the Justice Department said in a news release Friday. 

“Jones admitted in a plea agreement that in 2016 and 2017 he chatted with six underage girls on Facebook and enticed them to produce pornographic videos of themselves and send them to him,” the release said. “Jones told some of his victims to send him the videos as a way to ‘prove’ they were his biggest fans. He also told some of his victims that the videos were part of a modeling opportunity, and that he could assist them in gaining followers on Instagram.”

Jones also admitted to using Facebook around 30 other times to try to persuade minors to send him “sexually explicit” videos and photos, according to prosecutors

“Production and receipt of child pornography are extraordinarily serious offenses that threaten the safety of our children and communities,” Assistant U.S. Attorney Katherine Neff Welsh said in a sentencing memo. “Jones’ actions took something from his victims and their families that they will never be able to get back.”

Jones had faced a minimum sentence of five years in jail and a maximum sentence of two decades. Prosecutors asked for an 11-year sentence. 

“Today’s sentencing of Austin Jones represents a major step towards justice for the young victims whom he manipulated and exploited,” Homeland Security Investigations Special Agent-in-Charge James Gibbons said in a statement.

YouTube singer Austin Jones has been sentenced to 10 years in prison for asking underage girls to send him sexually explicit videos of themselves to prove that they’re fans.

Jones, 26, crooned a capella covers of popular songs and performed on tour nationwide. Most of the fans of the suburban Chicago singer were teenage girls.

In 2017, he was arrested on two counts of production of child pornography. Jones admitted to enticing six underage girls to make pornographic videos of themselves and send them to him, according to a plea agreement. The girls were as young as 14.

He pleaded guilty in February, and on Friday, US. District Judge John Z. Lee sentenced him to 10 years in federal prison.

“Production and receipt of child pornography are extraordinarily serious offenses that threaten the safety of our children and communities,” Assistant U.S. Attorney Katherine Neff Welsh said in the government’s sentencing memorandum. “Jones’ actions took something from his victims and their families that they will never be able to get back.”

To get the videos, Jones told some of the girls “to ‘prove’ they were his biggest fans,” that they “were part of a modeling opportunity, and that he could assist them in gaining followers on Instagram,” the Department of Justice said.

Jones admitted using Facebook to persuade minor girls to send him pornographic videos and pictures approximately 30 other times.

Even before his arrest, Jones had come under fire for his interactions with young fans. In June 2015, he posted a 16-minute YouTube video in which he looked directly into the camera and admitted that he used to ask fans to send him twerking videos.

“Nothing ever went further than twerking videos,” he said. “There were never any nudes, never any physical contact.”

Jones was first arrested in June 2017 at O’Hare International Airport and questioned in a recorded interview, the complaint states. He waived his Miranda rights and admitted to using Facebook to have sexually explicit chats with underage girls, receive explicit videos from them and view those videos for sexual pleasure.

A federal criminal complaint cites two instances of Jones messaging teenage girls to send him explicit videos of themselves dancing.

In one example, Jones messaged with a girl who told him she was 14 years old. Jones allegedly asked her to send videos of herself dancing in a sexual manner and referred to it as a “try out” and an “opportunity.”

According to the complaint, Jones instructed the girls on how to shake or “clap” their buttocks and expose themselves in videos for him.

“At the beginning, get super close and say these lines: hey Austin, it’s (name) and this butt is (age) years old and then make it clap for 30 seconds. Got it?” Jones wrote on Facebook to the girl, the complaint states.

She ultimately sent him about 15 videos of her dancing, including 10 videos in which she exposed herself, the complaint states.

A federal judge on Monday allowed YouTube star Austin Jones to remain on house arrest until he surrenders to federal prison authorities to start his 10-year sentence for coercing underage girls to perform sexually explicit dances during live online chats.

U.S. District Judge John Lee declined to take Jones into custody after a therapist who has treated him for nearly two years testified Jones has not expressed any thoughts of suicide for at least the last six months.

Lee also noted that Jones would benefit from continued mental health treatment before he must report to prison. The judge set June 28 for his surrender.

After Jones’ sentencing Friday, prosecutors had requested that he be taken into custody immediately, raising concern about his history of self-harm and suicidal thoughts.
