Demond Bluntson More News

A Webb County jury on Thursday sentenced someone to death row for the first time in almost 25 years. It was the second death sentence of the year in Texas.

Demond Bluntson, 40, received the death penalty in the 2012 shooting death of his 21-month-old son and his girlfriend’s 6-year-old boy. The jury deliberated for about 12 hours over two days before handing down the sentence.

“We feel very relieved and very grateful to the work done by the jury to bring justice to the families of these children,” said Webb County District Attorney Isidro Alaniz. “This is a historic case for our community.”

On June 19, 2012, police arrived at a Holiday Inn in Laredo for a welfare check on the boys and their mother, 28-year-old Brandy Cerny, according to the criminal complaint. El Campo police had called the department in an effort to locate Cerny, who was reported missing and had registered as a guest at a hotel.

Bluntson didn’t open the door for a hotel employee and police officers, only telling them “there’s kids in here,” according to the complaint. As employees and police began to force their way into the room, Bluntson fired a single shot through the door.

Three or four more shots rang out from inside the room before police were able to enter, the complaint said. Inside, they found the two children with gunshot wounds to their heads and Bluntson, who was detained.

Bluntson’s son, 21-month-old Devian, was pronounced dead at the scene. Devian’s half-brother, Jayden Thompson, 6, was rushed to the hospital and died the next day.

Before bringing the boys to Laredo, Bluntson allegedly shot and killed Cerny in El Campo, about 250 miles away, according to a Wharton County indictment.

Bluntson’s trial began on April 18, and he was convicted of capital murder within four days, according to court records. During his trial, Bluntson was removed from the courtroom several times for interrupting court proceedings, the records said. He watched much of the trial on a television screen from a holding cell.

During Alaniz’s opening statements of the punishment trial, Bluntson called him a liar, according to the Laredo Morning Times.

“Death row is nothing to me, man,” Bluntson said. “I don’t care about living. But I promise, you all won’t get away with what you have done.”

Alaniz said Laredo’s predominantly Hispanic and Catholic population is a factor when pursuing the death penalty.

“When you’re dealing in a community that’s predominantly Catholic, you never know how that is going to affect the decision of the jury,” he said. “It was a serious case, but they had all the evidence to make the decision, and we believe they made the right decision.”

Only two other people have been sent to death row from Webb County since the death penalty was reinstated in 1976, according to the Texas Department of Criminal Justice. Neither of the inmates was executed.

Amos Wells More News

A Tarrant County jury sentenced a Fort Worth man to death Friday in a 2013 triple slaying.

Amos Wells was convicted on Nov. 3 of capital murder in the deaths of his pregnant girlfriend Chanice Reed, 22; her mother, Annette Reed, 39; and Chanice Reed’s 10-year-old brother, Eddie McCuin, on July 1, 2013.

The jury deliberated for about four hours Friday afternoon before reaching the decision

“This has been a long trial,” said Kevin Rousseau, Tarrant County prosecutor. “The family is happy that justice was served. Nothing will replace the lives that were lost. But this was a necessary first step in the healing process.”

Prosecutors argued that after Wells shot his girlfriend and her mother, he chased Eddie through the house and shot him while he cowered on the floor

A woman who identified herself as Chanise Reed’s cousin said during her victim impact statement that she forgave Wells but still could not understand why he killed the woman and the unborn child he claimed he loved.

“There have been six deaths in our family between 2010 and 2012,” the woman said. “All we have left is memories that will never fade away.”

State District Judge Ruben Gonzalez allowed Wells’ family to speak to him after his death sentence was announced to a packed courtroom. Wells, who barely showed any emotion as his sentence was read, broke down in tears as they said their goodbyes.

One man said that he would do all that he could for Wells, including take care of his mother and daughter and supply him with whatever he needed while he was in prison waiting for the state to carry out his sentence.

“I did this,” Wells told his relatives. “I’m an adult. Don’t bear this burden. This burden is mine. The more you see me, the more you do for me, the more I will feel like I am putting this burden on you.”

On July 1, 2013, while first responders surrounded the residence in the 2900 block of Pate Drive where the shooting happened, Wells had already turned himself in at the Forest Hill Police Department.

Video surveillance showed Wells leaning on the counter top in front of a window that led to the police communication division. One officer leveled his service weapon at Wells, who begged for the police to take his life, according to testimony.

The last man to be sent to Death Row by a Tarrant County jury was Cedric Allen Ricks, who received a death sentence on May 16, 2014. Ricks got into an argument with Roxann Sanchez, his 30-year-old common-law wife and grabbed a kitchen knife and began stabbing the victim and her 12- and 8-year old sons.

Before Friday’s verdict there had been three death sentences handed down in Texas this year, according to The Texas Tribune. Last year, Texas sent two convicted killers to Death Row, the fewest since the U.S. Supreme Court upheld the state’s capital punishment statute nearly four decades ago, according to a Texas-based group that opposes the death penalty, the Tribune reported.

The state has scheduled executions for six offenders next year, according to Texas Department of Criminal Justice records. Three are from Tarrant County, two are from Dallas County and one is from Collin County.

John Falk More News

John Ray Falk Jr. was sentenced to die for his role in the murder of a correctional officer during an attempted escape from a Huntsville-area prison more than nine years ago.

An Angelina County jury deliberated for 28 minutes this morning before reaching a decision following closing arguments. Falk, who chose to represent himself, pleaded guilty to capital murder last Thursday for the slaying of Texas Department of Criminal Justice employee Susan Canfield of New Waverly.

The jury had the option to give Falk the death penalty or sentence him to life in prison without the possibility of parole.

Falk and another inmate, Jerry Duane Martin, ran away from a work detail at the Wynne Unit in Huntsville on Sept. 24, 2007. Canfield was killed while trying to prevent the escape when her horse was struck by a stolen truck driven by Martin in the garage area of the city of Huntsville Service Center adjacent to the prison.

The inmates were apprehended that day a few miles from the prison.

Martin was convicted of capital murder and sentenced to death in 2009 by a Leon County jury for Canfield’s murder. He was executed in 2013 after waiving his right to an appeal.

Joseph Colone More News

a Texas court has upheld the capital murder conviction and death sentence for a man who killed a mother and daughter.

The Texas Court of Criminal Appeals ruled Wednesday and denied the appeal of Joseph Colone.

In July of 2010, Colone shot and killed 41-year-old Mary Goodman and her 16-year-old daughter, Briana, at their home on Hartel Street in south Beaumont.

Mary Goodman had identified Colone as the man who robbed a Beaumont game room in June of 2010.

Prosecutors say he murdered Goodman to prevent her from testifying against him in that robbery and killed Briana because she was also at the home.

A jury in May 2017 decided Colone should receive the death penalty for the capital murder conviction and Judge Raquel West sentenced him to death.

Colone appealed, claiming among other things, the judge should have granted him a change of venue due to publicity about the case.

The appeals court ruled against Colone in each of the points of error he contends took place.

Billy Tracy More News

A Texas prison inmate who was sentenced to death for the 2015 killing of a Barry Telford Unit correctional officer was denied a new trial Wednesday by the Texas Court of Criminal Appeals in a unanimous decision.

Billy Joel Tracy, 42, was found guilty by a Bowie County jury of capital murder in November 2017 and sentenced to death by 102nd District Judge Bobby Lockhart. Tracy beat Timothy Davison, 47, to death with a metal bar used to open slots in the prisoner’s doors at mealtime.

Davison was escorting Tracy back to his one-man cell after an hour of recreation July 15, 2015. Tracy managed to escape his handcuffs and attacked Davison with his fists. Once Davison was on the ground, Tracy grabbed his slot bar, straddled Davison’s body and struck him repeatedly.

The jury at Tracy’s trial watched a video of the beating and heard testimony from dozens of witnesses, including other Texas correctional officers, who had been targets of Tracy’s assaults.

At the time of Davison’s murder, Tracy was serving a life sentence he received in 1998 in Rockwall County for the beating and abduction of a 16-year-old girl. Tracy was sentenced to 45 years for assaulting an officer in Potter County in 2007 and he received a 10-year sentence in 2011 for assaulting an officer in Jones County.

A date for Tracy’s execution has not been set.
