A Smith County jury has sentenced a man convicted in the 2017 shooting death of a gas station clerk to death.

Earlier on Wednesday, the jury heard the closing arguments from the prosecuting and defense attorneys. Since the charge is a capital offense, the jurors only have two options for Dameon Jamarc Mosley’s sentence – life in prison without parole or death.

A Smith County jury convicted Mosley of capital murder last week. He was charged in the fatal shooting of Billy Dale Stacks during an armed robbery. At the time of his death on Jan. 28, 2017, Stacks was working as a clerk at a Conoco gas station in Tyler.

The trial is being held in Judge Christi Kennedy’s 114th Judicial District Court.

The case will automatically be appealed, and attorney Jeff Hass will represent Mosley during the appeals process.

When Kennedy read the charges and gave her instructions to the jury, she explained that Special Issue No. 3 on the juror ballot is intellectual disability and that they have to decide if there is enough evidence to meet those criteria. She added that the jury has to agree unanimously on Special issue No. 3.

During his closing arguments, Chris Gatewood, a prosecutor for the Smith County District Attorney’s Office thanked the jurors for their service.

The state doesn’t want you to take this lightly,” Gatewood said. “If I had it my way, Mr. Stacks would be at work today, and Mosley would still be on probation.”

Gatewood told the jurors that there is a strong probability that Mosley would commit another crime.

The prosecutor told the jury that the burden of proof is on the defense to show that Mosley has an intellectual disability, which would warrant a life sentence instead of execution.

“We have proven that he is a threat to society,” Gatewood said. “He shot Billy Stacks in the head, took money out of the register, and picked the money up off of his dying body. Mosley has terrorized a lot of victims.”

Gatewood told the jurors that Mosley robbed again and again and reminded them that several witnesses testified about being scared for their lives during the previous crimes Mosley has committed.

“He started with a BB gun terrorizing people,” Gatewood said. “Then he graduated up to a real gun because someone bucked against him.”

During his closing arguments, Gatewood said Mosley committed five different robberies in 2014. He added Mosley appeared remorseful at that time, and the District Attorney’s Office gave him probation.

“We gave him a second chance, but that was a mistake,” Gatewood said. “While he was on probation, he committed 13 other robberies and killed Billy Stacks. He has an antisocial disorder. he doesn’t care about others.”

Gatewood argued that Mosley is not intellectually disabled, and he knows right from wrong.

One of Mosley’s defense attorneys reminded the jurors that they should focus on Mosley, not his victim. The attorney asked the jury, “How can Mosley continue to be a threat to society? G3 inmates aren’t allowed to roam around like they are on a college campus. They are controlled.”

The attorney stated that 70 percent of the inmates in the TDCJ prison system antisocial personality disorders.

“Life without parole is the highest punishment we have without death,” the defense attorney said. “Is this individual that dangerous. is this someone we have to kill?”

Robbie McClung, Mosley’s lead attorney, told the jurors that the State of Texas did not prove that Mosley is a threat to society. She said that the prosector named Mosely’s victims and that she would have felt the same way if she had been in their shoes.

“There is research that shows by the age of 40, they age out of antisocial disorder,” McClung said. “Prison teaches them things to understand what they did. The society he is going to live in until he dies is going to better him.”

Later, McClung gave a recap of testimony from Mosley’s mother, who admitted that she abused her son. She argued that Mosley never really had the structure or guidance he needed when he was growing up.

“Look at the other evidence and take it into consideration,” McClung said. ” Take everything into consideration. You are all parents. A parent’s goal is to make sure their kids understand right and wrong.”

McClung told the jurors that they should give justice to both the victim and the defendant. She added that there is enough evidence to warrant a sentence of life without parole.

In his closing arguments, Smith County District Attorney Jacob Putman countered that Mosley has had jobs and three different girlfriends. He added that Mosley graduated from high school with a curriculum that was suitable for his level.

“He knows right from wrong,” Putnam said.

Putnam told the jury that prison is basically a time out.

“I would love six hours of rec time a day,” Putnam said. “They get to go to the dayroom and play dominoes. They have a system of taking away your privileges to control you. I do the same thing. no sweets. Time out.”

According to court documents the Border Patrol Agent Javier Vega was on vacation with his family when he was shot by Gustavo Sandoval. Sandoval would also shoot Javier Vega father who thankfully survived the shooting. After the shooting Gustavo Sandoval would flee with an accomplice Ismael Hernandez Vallejo who would later be sentenced to fifty years in prison for his role and Sandoval was sentenced to death.

A jury on Tuesday decided Gustavo Tijerina Sandoval deserves the death penalty for the 2014 murder of a U.S. Border Patrol agent.

Tijerina Sandoval, 34, was convicted last week in the death of Javier Vega Jr., the border agent who was shot to death while fishing with family in a rural area near Harlingen.

On Aug. 3, 2014, Tijerina Sandoval and another man attempted to rob the Vega family at gunpoint, when Vega Jr., a veteran of the Marine Corps., pulled out his weapon. After a brief exchange of gunfire Vega Jr. was shot in the chest and died on the way to the hospital.

In addition to receiving the death penalty, Tijerina Sandoval was sentenced to life for attempted capital murder regarding the others in the Vega party. The Border Patrol agent’s father, Javier Vega Sr., was shot in the back during the firefight.

Vega’s widow, Andrea Brown Vega, and two of their three sons, as well as his mother and father, were all present and testified during Tijerina Sandoval’s trial, held in the courtroom of 197th state District Judge Migdalia Lopez.

Early in the proceedings, the judge issued a gag order prohibiting anyone connected to the trial from talking to the media. That order was still in place Tuesday, pending the formal handing down of the sentence.

Before the trial began and before the judge issued the gag order, the family declined comment but a Border Patrol union spokesman issued a statement.

“It is a very difficult time for the entire Vega family,” Chris Cabrera, a spokesman for the National Border Patrol Council, said Feb. 13 as jury selection started. “We, like the family, just want justice to be served.”

Vega’s father and mother, Marie Vega, mounted a lengthy fight to have their son’s death considered as having occurred in the line of duty, enlisting the help of several Texas congressmen and U.S. Sen. John Cornyn. In September 2016, a U.S. Border Patrol committee determined that Vega died in the line of duty.

Late last year the South Texas immigration checkpoint in Sarita, where Vega was stationed, was renamed in his honor.

Brandon McCall, the man accused of fatally shooting Richardson police officer David Sherrard in February 2018 was found guilty of capital murder Wednesday afternoon.

After closing statements were made at about 10:45 a.m., the Collin County jury deliberated only a couple of hours before rendering their guilty verdict.

McCall, who pleaded not guilty on Monday, was accused of fatally shooting both Richardson police officer David Sherrard and Rene Gamez II, who he was staying with at the time, on Feb. 7, 2018. Lawyers for McCall acknowledged he shot Sherrard, but said it was unintentional.

McCall was charged with capital murder for Sherrard’s death and murder for Gamez’s death. He will be tried for the death of Gamez at a later date.

A capital murder conviction in Texas comes with one of two punishments, either the death penalty or life in prison without parole. The Collin County District Attorney said they would be seeking the death penalty for McCall; sentencing will be held next week.

Investigators said McCall shot Gamez, 30, inside his apartment and then shot Sherrard twice as he responded to the “shots fired” call. Sherrard was shot twice in what a prosecutor described in court Tuesday as an ambush.

McCall was hospitalized after the incident and an officer who arrested McCall at his hospital bed wore a body camera. That footage was shown to the jury Tuesday

“You killed a cop tonight,” the officer was heard saying to McCall. Footage showed McCall deny it and say “No, nothing was wrong” and then cry. The officer testified in court Tuesday and told the jury that he believed it was all an act.

The prosecutor showed the jury Sherrard’s bloody uniform shirt and ballistic vest.

Sherrard’s family and friends who were sitting in court Tuesday were audibly upset, sniffling and gasping as the prosecutors showed the jurors the shirt Sherrard wore that day.

Investigators found three weapons (a rifle and two shotguns) inside the room where they believe McCall opened fire on police.

Sherrard did not fire his weapon during the incident, the investigator testified. Sherrard was shot with two rifle rounds: “center mass” or the center of his body, and at point-blank range.

A Houston serial killer was sentenced to death by a Harris County jury for his role in the strangulation of four people.

After five hours of deliberation, the jury decided Lucky Ward’s fate after he was convicted of strangling two people and is believed to have strangled two others in the Houston area as far back as 1985.

“Jurors had the courage to look at all the evidence, give a voice to the victims, and declare that he was the worst of the worst,” Harris County District Attorney Kim Ogg said. “Ward tortured and brutalized his victims with no mercy.”

The jury rejected the other option of a life sentence and agreed that Ward, 55, would have been a continuing threat to society.

Ward was convicted of capital murder for the deaths of Reita Long and Charlie Rodriguez in September 2010. Long and Rodriguez were found dead within weeks of each other. Prosecutors said one victim was found dead on the steps of a Co-Cathedral of the Sacred Heart building and the other was covered in a blanket in a north Houston home.

Prosecutors also believed Ward was tied to the deaths of 51-year-old Myra Ical and Carol E. Flood, 62, in 2010. They said he was also tied to the strangulation of Birdell Louis in 1985.

“What we have here is a serial killer,” said Prosecutor Colleen Barnett said. “The circumstances are indeed horrific.”

Prosecutors told the jurors how Ward had committed a series of crimes that date back to at least 1979. In one crime, prosecutors said he raped an 83-year-old woman in Brazoria County and he was sentenced to more than two decades in prison.

In 2018, while Ward was awaiting trial for capital murder, prosecutors said he was charged after being caught with a shank while in the Harris County jail.
