“The crying after a while just got to be overwhelming,” said death row inmate Travis Mullis.

In 2008, a then 21-year-old Mullis became known as the dad who killed his infant son because he wouldn’t stop crying.

Just hours before that happened, Mullis says he took a friend’s 8-year-old daughter to her school’s playground.

“I attempted to take her clothes off, she wouldn’t do it. She started crying,” Mullis said.

Mullis says his intention was to molest her. After taking the little girl home, Mullis says he left with his 3-month-old son.

“He started crying. I tried to console him. I thought it would work, but it didn’t work. I sexually assaulted him and killed him,” said Mullis. “I put him on the side of the road and stomped on his skull until it collapsed.”

Mullis is not your typical death row inmate. He’s never claimed to be innocent, and he has no complaints about life on death row. He says he’s just ready for justice to be served.

“I’m guilty of what I did and the death penalty is the legally justified and I believe morally sentence for what I’ve done,” he said.

Mullis knows he could spend many years here while the appeal process slowly grinds.

He’s filed a motion to stop his federal appeal and get rid of his attorney.

“I’m ready to accept my punishment,” said the death row inmate.

We asked Mullis, who says he’s a Christian, where he would be spending the afterlife.

“If I go to hell, I go to hell,”  Mullis said, then mentioned that he asked God to forgive him a long time ago.

A Texas man who had waived his right to appeal his death sentence received a lethal injection Tuesday evening for killing his 3-month-old son more than 16 years ago, one of five executions scheduled within a week’s time in the U.S.

Travis Mullis, 38, was pronounced dead at 7:01 p.m. CDT following the injection at the state penitentiary in Huntsville. He was condemned for stomping to death his son Alijah in January 2008.

“I’d like to thank everyone … that accepted me for the man I became during my best and worst moments,” Mullis, while strapped to the death chamber gurney, said after his spiritual adviser offered a brief prayer over him.

He also thanked prison officials and staff for “changes made across the system” that allowed “even the men on death row to show it is possible to be rehabilitated and not deemed a threat and not the men we were when we came into this system.”

He added that while he “took the legal steps to expedite to include assisted suicide, I don’t regret this decision, to legally expedite this process. … I do regret the decision to take the life of my son.” He apologized to his son’s mother, to her family and said he had no ill will toward anyone involved in the punishment

“It was my decision that put me here,” he said.

The execution was delayed about 20 minutes while technicians worked to find a suitable vein. One needle carrying the lethal dose of the sedative pentobarbital was inserted in his right arm, the usual procedure. A second needle, rather than entering his left arm, was inserted in his left foot.

He closed his eyes as the drug began taking effect and took seven barely audible breaths before his breathing abruptly stopped. He was pronounced dead 20 minutes late

Mullis was the fourth inmate put to death this year in Texas, the nation’s busiest capital punishment state. Another execution was carried out Tuesday evening in Missouri, and executions were also scheduled to take place Thursday in Oklahoma and Alabama. South Carolina conducted an execution Friday

Authorities said Mullis, then 21 and living in Brazoria County, drove to nearby Galveston with his son after fighting with his girlfriend. Mullis parked his car and sexually assaulted his son. After the infant began to cry uncontrollably, Mullis began strangling the child before taking him out of the car and stomping on his head, according to authorities.

The infant’s body was later found on the roadside. Mullis fled the state but was later arrested after surrendering to police in Philadelphia.

Mullis’ execution proceeded after one of his attorneys, Shawn Nolan, said Tuesday afternoon that he planned no late appeals in a bid to spare the inmate’s life. Nolan also said in a statement that Texas would be executing a “redeemed man” who has always accepted responsibility for committing “an awful crime.”

In a letter submitted in February to U.S. District Judge George Hanks in Houston, Mullis wrote that he had no desire to challenge his case any further. Mullis has previously taken responsibility for his son’s death and has said “his punishment fit the crime.”

In fact, the suspect would have been in jail the day they were killed, but he had been released early.Joseph Jean, 37, is facing capital murder charges over the deaths of cousins Chelsy Lang, 16 and Ashley Johnson, 16. Their bodies were found Sunday in a burning Baytown home.Jean appeared Friday morning in an orange jail jumpsuit with his hands cuffed behind his back. He was granted a court-appointed attorney, telling the court he went to the home of his ex-girlfriend to start a fire.What he’s charged with though are the murders of the two girls inside.

Police say the cousins were bludgeoned to death with a baseball bat before the fire was ignited.In a warrant released Thursday, Jean is said to have claimed the girl surprised him at the house. He had, according to witnesses, argued with the mother of one of the girls the night before the murder in a Houston club.Jean was in and out of prison for 20 years, averaging about one charge per year, yet he was released from prison seven months early. Some people believe that is one more element to an already tragic story.”From my perspective, you had somebody who was a ticking time bomb waiting to explode,” said Andy Kahan, crime victims advocate.In 2006, Jean was arrested for breaking into the house of his girlfriend at the time, Victoria Wiley. Her daughter Chelsy was the one who called police. He beat Wiley for reporting the burglary case to authorities which sent him to prison. He was paroled and while out he made threatening phone calls to Wiley which sent him back to prison, where he was supposed to remain until May of this year.”If that decision would have stood up, obviously we’re not talking today and the two girls are alive and none of this happens. However, by statue, he’s also eligible for what’s called discretionary mandatory release,” said Kahan.

That gives the prison board discretion over the early release of inmates. In recent weeks there was another high-profile case involving another discretionary release – Mabry Landor, convicted of killing Houston Police Department Officer Tim Abernethy. Landor too was granted parole, after which he killed Officer Abernethy. Like Landor, Jean’s case was rejected by the board which reversed itself only two months later.”I think the purpose for discretionary mandatory release was for offenders who have little or no criminal history, to get them out,” said Kahan. “But for guys who demonstrate repeatedly that they’re going to commit crimes, I don’t think the intent was for them to get out. But somehow they are.”Kahan believes that the legislature should impose some restrictions on that policy when it meets again next year.

Jean is charged with one count of capital murder – one charge for the two girls – as well as starting the fire. He is being held in Harris County jail without bond.The girls’ funeral service will be held on Tuesday. An account has been set up at Bank of America by Victoria Wiley’s employer for public donations for the family.

The Texas Court of Criminal Appeals on Monday halted an execution set for this week due to the new coronavirus.

The state’s high criminal court ordered that Wednesday’s execution, set for 44-year-old John Hummel, should be delayed “in light of the current health crisis and the enormous resources needed to address that emergency.” The stay is in place for 60 days, after which the county can move to set a new execution date.

Hummel’s lawyer requested a stay of execution in a unique court filing Friday because of the spread of COVID-19 and the state’s disaster declaration, arguing that the disease has impacted his ability to carry out last-minute investigations. He also said the execution procedure, which crowds family members, the media and officials into small viewing rooms, puts vulnerable prisons at risk of exposure.

But Tarrant County officials opposed the request, claiming it was speculative and should not prevent Hummel’s execution for the “heinous, brutal, and calculated murders of his family members.”

Hummel was sentenced to death by a Tarrant County jury in 2011 after the 2009 murders of his pregnant wife, his 5-year-old daughter and his father-in-law. Police found their burned, beaten bodies after responding to a fire at their home in the early morning, according to court records. Officials determined that they died by blunt-force injuries in or near their beds before the fire was set.

In his first interview with police, Hummel said he had gone to the storeand was not home at the time of the crime, but he later confessed to stabbing and beating his wife before beating the other two and setting fire to his house, records show.

The court’s decision Monday was not the first time an execution has been stopped because of state or national emergencies. In Hummel’s filing, his attorney pointed to former Gov. Rick Perry granting a 30-day reprieve for an execution scheduled on Sept. 11, 2001. A Bexar County court also withdrew an execution date shortly after Hurricane Harvey in 2017 because the defense attorney lived in Harris County.

There are seven other executions scheduled in Texas through June, including one more in March and two in April, according to the Texas Department of Criminal Justice’s website. It was not immediately clear if more executions would be delayed. Scott Smith, the attorney for Tracy Beatty, whose execution is set for March 25, said Monday after the ruling that he planned to file his own motion to the Court of Criminal Appeals asking to stop Beatty’s execution, too.

A Houston death row inmate who admitted to killing a man over flashy car rims lost out on a federal appeal Friday despite claims of bad lawyering and brain damage.

Former gang member Teddrick Batiste was sent to death row in 2011 for the slaying of Horace Holiday, who was gunned down outside a gas station along Eastex Freeway, according to court records.

Just after 3 a.m. one night in 2009, Batiste and an accomplice started trailing their target’s white Cadillac, planning to steal the car and its spinning rims as Holiday left a club.

The then-23-year-old opened fire on the Cadillac as Holiday drove down the highway. When the wounded man got off the road to get help, he careened into a gas pump at a nearby convenience store, then got out and tried crawling to safety.

Batiste followed and continued shooting. Police heard the gunfire and rushed to the scene, just in time to spot Batiste driving off in his victim’s car

The fleeing killer led officers on an 8-mile high-speed chase before he was captured. Afterward, he confessed to his crimes and admitted his role as the triggerman.

The slaying that could send him to the death house came weeks after a robbery and another capital murder, cases the jury heard about during the punishment phase of the Harris County trial.

In March of that same year, Batiste and two other men toting semi-automatics stormed into the Phat Kat Tats tattoo shop and held a family at gunpoint as they stole electronics and tattoo machines.

Then in early April, Batiste and two accomplices robbed Black Widow tattoo parlor, firing 16 shots and killing the owner.

But the court also heard about Batiste’s better side – his diligent work on a forging crew, his role as a father and his “caring” nature as an older brother. Batiste told the court how he planned to step back from his role in the gang and be a positive influence in prison if he got a life sentence.

The jury voted for death after just over 2 hours of deliberation. When the court announced the verdict, the condemned man’s mother screamed and pleaded just outside the courtroom.

A 39-year-old Houston man is charged with capital murder after allegedly shooting his estranged wife and 15-year-old daughter dead.

The incident happened about 7:30 p.m. Thursday at a southeast Houston apartment complex. Police say Jaime Piero Cole was dropping off his sons, ages 2 and 10, at Melissa Dawn Cole’s apartment when a fight developed between the adults. Police say that when the woman’s 15-year-old daughter, Alecia Desire Castillo tried to intervene, Jaime Cole drew a gun and shot mother and daughter several times.

Police investigator H.A. Chavez says Jaime Cole left his 10-year-old son behind and fled with his 2-year-old son. After an Amber Alert was issued, the two were seen in a Walmart store in Wharton, 55 miles to the southwest. A Texas Department of Public Safety trooper arrested Cole. His sons are unharmed.
