Months after a William Roger Davis III was found guilty of kidnapping, raping and murdering a Longwood used-car lot receptionist, the Supreme Court of Florida has upheld the decision to sentence him to death.

Davis, who requested the death penalty, never denied his involvement in the brutal death 19-year-old Fabiana Malave. Instead he claimed insanity and said “Dr. Paul,” a person he said he saw when he hallucinated, told him to kill the woman in October 2009.

According to evidence presented at trial, Davis abducted Malave at knifepoint from Super Sport Auto, the small car lot on U.S. Highway 17-92 where she worked and drove her to the Orlando house where he lived. Davis raped her then strangled her.

He then wrapped her in a carpet and a plastic bag and loaded her body into his SUV and drove around for hours before parking a few dozen feet from where he had abducted her. Seminole County deputies spotted the vehicle and arrested him.

Davis told investigators “he had never killed anyone before, but found the murder ‘interesting’ and ‘liberating’ and that he would certainly kill again,” according to a Supreme Court report.

Davis was evaluated by several mental-health experts who determined that his IQ was 127, just three points short of genius level. While some doctors thought his mental health was in question because he was abused as a child, others thought he was smart enough to exaggerate his symptoms in an effort to avoid prison.

The doctors thought Davis’ need to kill might have also been fueled by a recent separation from his girlfriend at the time. Davis told investigators that “Dr. Paul” said the only way his ex-girlfriend and her son would be safe was if he killed Malave, who was the only employee at the car lot the day she was abducted.

Davis also told investigators that he couldn’t bring himself to kill Malave and said he thought “Dr. Paul” might have killed her when he left the room.

The Florida Supreme Court made its decision Oct. 9.

A 47-year-old man already on death row for a murder in Manatee County has been convicted by a jury of second degree murder and two counts of sexual battery with a deadly weapon.

Delmar Smith III of Ralford, Fla. was linked by DNA to the murder of 34-year-old Georgeann Smith in April 2009. The victim was beaten to death with a baseball bat after being sexually battered with foreign objects that were left inside her body.

In November 2017, Smith’s DNA was found on the victim’s clothing from the day she was killed. He was charged with the victim’s murder and after his conviction Friday was sentenced to two concurrent life terms in prison.

“Delmer Smith’s DNA was the silent witness in this case,” Assistant State Attorney Karen Fraivillig, the lead prosecutor on the case, said. “Justice for Georgann Smith was delayed for 10 years until the science of DNA analysis become more sophisticated and more discriminating. Now her killer has been identified and will be held accountable for her brutal and bloody death.”

Detectives say the victim was a stranger to Smith and there was no reasonable explanation as to why he attacked her. But detectives say Smith committed a series of similar heinous acts.

Smith was previously arrested in Sarasota County in October 2009 after being tied to a series of home invasion robberies throughout Sarasota and Manatee counties where he sexually battered the victims in the same manner – tying them up, sexually battering them with a foreign object, and beating them. He was sentenced to life in connection to one of those crimes after being convicted in 2011.

The crimes stopped after Smith’s arrest in October 2009 and he was later connected to a murder in Manatee County.

On August 3, 2009 Kathleen Briles was found dead in her home by her husband, who found her bound with a gag in her mouth. She had been killed by being struck with a cast-iron antique sewing machine.

In that case, Smith was charged in February 2010 and convicted in 2013 of first degree murder. Smith was sentenced to death.

Khadafy Mullens, a high-school dropout who killed two people in a St. Petersburg convenience store robbery captured on videotape, was sentenced to death this morning.

On April 29, Mullens, 30, of St. Petersburg, took the unusual step of pleading guilty to all the charges he was facing — two counts of first-degree murder and one count of attempted first-degree murder — without anything promised in return, even though prosecutors were seeking the death penalty.

Typically, once a defendant facing death sentence is convicted of first-degree murder in Florida, a jury hears evidence before issuing a recommendation for or against the death penalty. They take a vote, and that vote is passed along to the presiding judge, who has to give it great weight before deciding whether the person should be executed or serve a life prison sentence.

That’s not what happened with Mullens, though.

At Mullens’ April 29 plea hearing, Assistant Public Defender Jill Menadier asked Circuit Judge Philip Federico if he would waive the death penalty phase of the case, where jurors hear testimony, and make the decision himself without a jury recommendation. Federico obliged, much to the disappointment of prosecutors, who wanted jurors to play a role, as they represent the community at large.

The judge’s decision meant Federico would decide Mullens’ fate on his own.

On Aug. 17, 2008, Mullens and an accomplice went into the Central Food Mart at 2157 Central Ave. in St. Petersburg and robbed the store. Mullens fatally shot the owner, Mohammad Uddin, and a transient, Ronald Hayworth, who stumbled upon the robbery. He then grabbed a customer entering the store, Albert Barton, dragged him inside and shot him in the face. Barton survived.

The latest appeal for Steven Anthony Cozzie has been denied by Florida’s highest court.

In an opinion released Thursday, the Supreme Court of Florida upheld Cozzie’s death sentence.

In the 6-1 ruling, the justices said Cozzie’s sentence “is proportional in relation to other death sentences that this Court has upheld.”

Cozzie, 27, strangled, beat and sexually battered Courtney Wilkes, 15, on June 16, 2011 in a wooded area near Seagrove Beach in Walton County. Wilkes was on vacation with her family when the murder happened on the day before the family was scheduled to go home.

A jury recommended death for Cozzie by a 12-0 vote when he was convicted of the crime. Cozzie was 21 when the crime occurred.

In upholding the jury’s recommendation of death Justices wrote “This Court has repeatedly affirmed the death penalty where the defendant has kidnapped, sexually battered, and murdered a child victim…. Accordingly, Cozzie’s death sentence is proportionate. For the foregoing reasons, we affirm Cozzie’s conviction for first-degree premeditated or felony murder with a weapon and his sentence of death.”

A judge on Thursday agreed with a second jury’s capital punishment recommendation and resentence Michael Bargo to death for his conviction in the slaying of a 15-year-old Marion County boy.

Bargo, now 27, was first sentenced to death in 2013 for the 2011 killing of Seath Jackson. The original jury reached the recommendation for death in a 10-2 vote but in 2016, the Florida Supreme Court ruled juries must be unanimous in recommending the death penalty. As a result, the court ordered resentencing for people on death row who did not receive a unanimous jury recommendation.

During Bargo’s resentencing in April a jury unanimously recommended the death sentence. On Thursday, the judge officially handed down Bargo’s death sentence.

In 2011, Bargo and four friends lured Jackson to a home in Summerfield, where Bargo shot the 15-year-old multiple times. The group then burned the body in a fire pit and disposed of the ashes by putting them in buckets and dumping them in a quarry.

Bargo’s four co-defendants were each convicted and sentenced to life in prison.

During the resentencing, the state detailed the crime and Bargo’s role in it. The prosecution called the crime cold, calculated and premeditated, and asked the jury to recommend the death penalty.

The defense went through Bargo’s history of family problems and mental illness. Bargo’s attorney said those factors played a role in his decision-making, and she asked the jury to recommend life in prison without the possibility of parole.

Both the state and the defense called several witnesses before a jury recommended death for Bargo.

Bargo was returned to the custody of the Florida Department of Corrections after the new sentencing

The Florida Supreme Court on Thursday upheld a death sentence in the high-profile murder of a 15-year-old boy in 2011 in Marion County.

Justices, in a 6-1 decision, rejected an appeal by Michael Shane Bargo, who was convicted in the murder of Seath Jackson.

The victim was lured to a home and then attacked by Bargo and co-defendants, before being fatally shot by Bargo, according to the Supreme Court opinion. Jackson’s body was burned, with the ashes disposed in a water-filled rock quarry.

After Bargo was convicted, a jury voted 10-2 to recommend that he should face the death penalty. A circuit judge sentenced him to death, but the Supreme Court later ordered a new sentencing hearing because the jury recommendation was not unanimous.

During the resentencing, a jury unanimously recommended a death sentence, which was imposed. In the appeal, Bargo’s attorney raised a series of issues, including that a circuit judge had not appropriately considered “mitigating” factors involving Bargo having mental conditions.

But the Supreme Court majority, made up of Chief Justice Charles Canady and Justices Ricky Polston, Alan Lawson, Carlos Muniz, John Couriel and Jamie Grosshans, rejected the arguments.

Justice Jorge Labarga dissented, writing that the court should have conducted what is known as a “comparative proportionality review” that analyzes aggravating and mitigating factors in the case, Bargo, now 29, is an inmate at Union Correctional Institution, according to the state Department of Corrections website.
