The man accused of last week’s carjacking of a woman at the Costco gas station confessed to fatally shooting a 12-year-old boy in what was New Orleans’ first homicide of 2022, police said in court documents filed Monday (Feb. 7).

As first reported by Fox 8, 18-year-old Tyrese Harris was booked with second-degree murder in connection with the fatal shooting of 12-year-old Derrick Cash. Cash emerged from a stolen car in the 14000 block of Michoud Boulevard in New Orleans East on Jan. 3 and died at the scene from multiple gunshot wounds, New Orleans police said.

Harris, who was arrested Sunday and accused of the brutal Feb. 1 carjacking of realtor Kelleye Rhein at the Costco fueling station, was booked with the Cash murder and the attempted armed robbery of another man’s car from a convenience store gas station on Howard Avenue on Jan. 18.

In that failed carjacking attempt, police said Harris fired shots at the would-be victim before fleeing but dropped a cellphone at the scene that contained evidence police said linked him to the killing of Cash.

NOPD homicide detectives wrote in the affidavit that they confronted Harris with the evidence Sunday after he had been read his Miranda rights.

“During the recorded interview, Mr. Harris admitted to committing the shooting (of Cash) on Michoud Boulevard,” homicide detective Walter Edmond wrote in his sworn affidavit. “Harris stated he was armed with a .45-caliber firearm and he shot the victim several times.”

The cellphone Harris fumbled and lost during the Jan. 18 carjacking attempt also contained evidence documenting Harris’ efforts to dispose of that murder weapon, Edmond wrote.

“Harris was trying to get rid of the gun by trading it,” Edmond wrote.

A man has been arrested in connection with several carjacking incidents across New Orleans, including two at a Costco gas station last week.

According to officials, the NOPD’s Violent Warrant Squad and the U.S. Marshals located 18-year-old Tyrese Harris in the investigation of an unarmed carjacking that took place Tuesday afternoon in the 3800 block of South Carrollton Avenue.

Harris was taken in without incident in the 1500 block of Milton Street. Officials said Harris was identified through their investigation and a warrant was obtained on a charge of principal to simple carjacking.

According to jail records, Harris was arrested for armed robbery with a fire arm in September of 2021, but the Orleans Parish District Attorney refused that charge two months later on November 10th.

Earlier in the week, WDSU spoke to the family of Kelleye Rhein, who was pumping gas when her car was stolen. Rhein was badly injured in the incident after being dragged roughly 30 feet from where she was pumping gas.

NOPD confirmed that the second-degree murder charge is in connection with the murder of 12-year-old Derrick Cash.

Cash was shot and killed in New Orleans East. Next to Cash’s body was a stolen black Jeep Cherokee. The car was stolen at the Pontchartrain Hotel when a couple attempted to valet their vehicle.

Harris is currently being held on charges of attempted armed robbery, attempted armed robbery with a firearm, aggravated criminal damage to property, illegal use of a weapon, illegal carrying of a weapon, principal to carjacking, and second degree murder.

His total bond for these charges is set at $2.76 million.

Criminal history:

Court documents outline Tyrese Harris’ alleged involvement in a carjacking on Howard Avenue as well as the two Costco carjacking incidents reported last week.

According to the documents, On Jan. 18, Harris was accused of attempting to carjack someone at the Circle K on Howard Avenue.

Court records show that the victim of the carjacking attempt was pumping gas when a white Volkswagen SUV turned into the gas station parking lot.

The victim said he saw a suspect, later identified as Tyrese Harris, close his driver’s side door of his car.

Court records show the victim pulled a gun out and aimed it at Harris in an attempt to scare him away.

The Volkswagen drove off, leaving Harris in the victim’s car, according to court documents. Harris is then accused of pointing a gun at the victim and firing shots as he ran away from the car.

Court documents show that police found a cellphone and spent shell casings on Carondelet Street, where Tyrese Harris had run following the incident.

Police say the cellphone found on the ground was traced and determined to belong to Harris.

According to court records, a second victim reported having their car damaged by gunfire on Carondelet Street where Harris’ cellphone was found.

Police were able to determine that the victim was attempting to turn into the gas station parking lot when his car was struck by gunfire two times by Harris, who was running from the first victim’s car, according to court records.

Just days later, police began investigating a carjacking incident at the Costco gas station that severely injured Rhein.

According to court records, police arrived at the scene of the carjacking where Rhein was found on the ground bleeding.

Rhein, who was knocked unconscious after being dragged during the carjacking, was unable to give police any information about the incident.

Court documents show that police spoke with witnesses on scene who had surveillance footage of a black SUV and a white SUV pulling out of the parking lot of the Costco following the carjacking.

The witness said the vehicles got stuck on Palmetto Street and drove off in the wrong direction on Cambronne Street.

Witnesses described the suspect as wearing distinct clothing.

Court records show just a day before, on Jan. 31, a carjacking attempt was made at the same gas station.

According to court records, the video showed that the suspect was wearing the same distinct clothing as the incident reported on Feb. 1.

Police then turned to social media where they were able to find Harris’ Instagram, according to court documents.

Court records show Tyrese Harris was wearing the clothing described in both Costco carjacking incidents in the Instagram Live video on Feb. 2.

Ronald Black Cloud More News

An 18-year-old Rapid City man has been sentenced to 40 years in state prison for a fatal shooting in 2018.

A judge Monday sentenced Ronald Black Cloud in the death of 43-year-old Nathan Graham. Black Cloud was found guilty last October of second-degree murder for shooting Graham in the head, the Rapid City Journal reported.

Black Cloud was sentenced under a set of rules that prohibit minors from being sent to prison for life without a chance of parole. He was 14 when the crime was committed.

According to Pennington County State’s Attorney Mark Vargo, Black Cloud cannot be given a life sentence without parole due to a series of U.S. Supreme Court rulings that indicated how minors charged as adults can be sentenced. South Dakota state law has changed to align with these rulings.

Black Cloud will receive about 3 1/2 years of credit for time he has spent in the county jail.

Ross Johnson, who told Black Cloud to shoot Graham, was sentenced to 20 years in prison in last June after pleading guilty to aggravated assault and being an accessory to second-degree murder.

teenager accused of murder who has been incarcerated since August 2018 will likely remain in jail after a judge set his bond at $500,000 cash-only.

Ronald Black Cloud, wearing a navy blue scrub-like outfit with his hands cuffed in front of him, made his first appearance in adult court on Wednesday morning at the Pennington County Courthouse.

Black Cloud was 14 when he was charged with second-degree murder in juvenile court for the Aug. 17, 2018, fatal shooting of 43-year-old Nathan Graham. Graham, a father who owned a construction company and planned to hire troubled teens and adults with felonies, died the next day.

Prosecutors argued during a closed-door transfer hearing in December that Black Cloud, now 17, should be tried in adult court. Judge Matt Brown agreed.

Ross Johnson, now 19, was 17 when he was charged with aiding and abetting second-degree murder as well as aggravated assault in the case. State law says minors who are 16 or older are automatically charged as adults when facing serious felony charges.

Johnson originally planned to request a transfer to juvenile court but later decided to stay in adult court. He pleaded guilty to aggravated assault last week in exchange for testifying against Black Cloud if the younger teen takes his case to trial.

Prosecutor Angela Shute requested the $500,000 cash-only bond and a no contact order for Graham’s wife and stepson.

She said Black Cloud and Johnson had been shooting a handgun earlier in the day before going to Graham’s house to ask if his son wanted to spend time with them.

Shayla Colbert-Graham, Graham’s widow, previously told the Journal that Johnson was friends with their son but he wasn’t allowed to visit their house since they once caught him trying to break into the home with alcohol.

Colbert-Graham said she opened the door that day to find Johnson and Black Cloud, who she did not recognize. She said Johnson asked to see her son and she responded that he knows he’s not allowed at the house. Graham then came to the door to back her up.

Graham told the teens that they weren’t welcome at his house and a fight broke out between him and Johnson, Shute said. Johnson tossed the gun to Black Cloud who fired it twice as Graham was returning to his house. One of the shots hit Graham in the back of the head.

Johnson had told Black Cloud to shoot the gun, prosecutor Lara Roetzel previously told the Journal. Black Cloud fired once the fight was already over so there was no need to defend himself or Johnson, she said.

An affidavit says Black Cloud told police that Johnson told him to fire the gun and a relative of Johnson said Johnson told them the same thing. Johnson told Graham when he arrived that he had a gun and would shoot everyone, the document also says.

Shute said her bond request was needed due to the serious nature of the offense. She did not comment on whether Black Cloud was a flight risk or danger to others.

Defense lawyer Joanna Lawler requested a “reasonable” bond but not a specific amount.

She said Black Cloud turned himself in to police, has already been detained for a long time, and is not a flight risk since he has supportive family members, some of whom attended the court hearing.

Magistrate Judge Todd Hyronimus agreed with the requests for the $500,000 cash-only bond and no contact orders.

A relative blew Black Cloud a kiss before deputies walked him away.

Black Cloud will continue to be detained at the juvenile jail until he is 18. Johnson, who is detained at the adult jail, could be sentenced up to 15 years in prison during his hearing on April 29.

If Black Cloud or Johnson had been convicted in juvenile court, the judge could have sentenced them to prison up until they were 21.

Adults convicted of second-degree murder face an automatic sentence of life in prison without parole. Minors charged in adult court must have the chance of parole but can be sentenced to any number of years, even as long as 261 years, the South Dakota Supreme Court ruled.

Nicholas Pagano, the man suspected of setting a colleague on fire Monday at Hackensack University Medical Center, was found dead 24 hours later of a self-inflicted gunshot wound, according to authorities.

The Bergen County Prosecutor’s Office said Pagano’s body was discovered Tuesday morning in Waterford Township. He was wanted on charges of attempted murder, aggravated arson, aggravated assault and unlawful weapons possession.

Pagano left the hospital and after a manhunt, his body was found Tuesday morning in Camden County.

The 54-year-old victim suffered third-degree burns and needed stitches on her head. She was treated at the emergency room before being transferred to another hospital.

Brittany Dawn Davis Sued By Texas For Fraud

Brittany Dawn Davis

In current social media news Brittany Dawn Davis an influencer has been sued by the State of Texas for fraud. Turns out this “Jesus Seeker” “Kingdom Chaser” “Wifey” which is terms that Brittany Dawn Davis uses to describe herself is full of baloney. It seems that honesty is not a big quality in Brittany Davis life as she has been allegedly scamming her followers selling fitness programs that do not even come close to delivering their promises. Part of the problem is that Brittany Dawn Davis promises individual programs to her followers but they are actually mass produced and that is just the start of the fraud problems that Davis has been accused of. Also Brittany Dawn Davis will delete any negative comments on her site and videos plus when a customer calls in with a complaint the chance of her replying to her customers concerns is slim to none. It is pretty bad when someone is being sued by a State for fraud.

Brittany Dawn Davis More News

The State of Texas is suing North Texas influencer Brittany Dawn Davis, accusing her of deceptive practices.

Davis, known as Brittany Dawn on social media, sold workout and diet plans.

The lawsuit says Davis did not provide personalized plans and failed to follow through on follow-ups and check-in with clients.

It also lists complaints from customers, including how one woman almost passed out from inadequate nutrition.

Clients also complained about problems getting refunds.

The state is seeking between $250,000 to $1 million in penalties, along with court fees.

Brittany Dawn Davis Other News

A social media influencer in Dallas-Fort Worth scammed thousands of clients whom she sold fitness and nutrition plans to, according to a new lawsuit from the Texas Attorney General’s office.

Brittany Dawn Davis has close to one million TikTok followers and half-a-million on Instagram where she shares fitness and health tips. She also runs a YouTube channel with nearly 250,000 subscribers.

But the Texas Attorney General’s Office has filed a Deceptive Trade Practices Act lawsuit against Davis claiming she never provided any of the personal coaching promised and that the plans weren’t customized.

Cori Reali of Wisconsin spent $115 on a plan back in 2014 when Davis began selling them.

“She made it sound so easy: ‘Just reach out. I want to help all of you,’” Reali said.

The plan, though, didn’t have her name on it, and Reali said she never received specific feedback. Instead, she gained nine pounds after two weeks.

“The red flags started to go up,” Reali said. “I was not individualized. I was not part of this ‘Team Brittany Dawn.’ It set me back. It actually pushed me back into my eating disorder.”

When complaints started in 2019, Davis posted videos saying her customer service team was refunding clients. She also apologized on Good Morning America, admitting she had asked clients she refunded to sign non-disclosure agreements and that she deleted comments on her social media channels from people who called out her business practices.

“I jumped into an industry that had no instruction manual,” Davis said in 2019. “I’m basically going through uncharted territory, and I’m doing the best that I can to the best of my ability.”

Reali said she doesn’t buy that.

“You clearly are not sorry, and you need to be held accountable,” Reali told WFAA on Monday. “She literally just took the money and ran with it.”

Reali filed a complaint with the attorney general’s consumer complaint division in 2019, but never heard anything – until the office reached out last week after filing the case.

“I’m happy that there’s some progress to shine a light on her and her practices because maybe, just maybe, people will connect that it’s the same person,” Reali said.

The suit from the state attorney general’s office claimed, in one instance, two clients with a 140-pound weight difference discovered their recommended calorie intake was only 60 calories different. Brittany Dawn Davis also allegedly provided plans designed for weight loss to clients who were trying to gain weight.

WFAA attempted to contact Davis multiple times for a comment, but we did not get a response.

At least 14 customers who asked for refunds mentioned an eating disorder, according to the lawsuit.

Meanwhile, Davis also allegedly charged a shipping fee for plans, even though they were emailed. The plans ranged from $92 to $300.

The attorney general’s office is asking for between $250,000 and $1 million.

“I’m sorry for anyone who feels hurt or scammed,” Davis said in a 2019 video posted to her channel.

The influencer has continued to post content online.

In 2020, she received more than $20,000 in forgivable paycheck protection loan money for her business.

After the issues with her health program, she pivoted from fitness to spirituality content and created the account @SheLivesFreed. Davis’ new spirituality program plans to host a one-day retreat in Fort Worth in April for $125 per person.

Reali slammed that move, too, calling it “disgusting.”

“It’s just another scam,” she accused.
