A York County teenager accused of killing a 12-year-old boy will be in court today to find out if he will still be charged as an adult.

Nolan Grove is currently facing third-degree murder charges as an adult for the shooting death of Kain Heiland. Grove was only 13 when the shooting happened in April of 2023 in Red Lion.

The judge has ruled that there is enough evidence for Grove to stand trial.

Friday’s hearing is scheduled for 9:30 a.m. at the York County Courthouse.

Kain Heiland, 12, was shot and killed on Saturday, April 1, 2023 in Red Lion. At a news conference held days after the shooting, York County District Attorney Dave Sunday said that Grove shot Heiland in the back.

According to the affidavit of probable cause, a witness told investigators that Grove made a joke about Heiland’s mother. Heiland told Grove to shut up, and then Grove allegedly shot Heiland once.
Key evidence

At the same news conference, Sunday said witnesses and video were key evidence for the grand jury.

Charging documents indicate surveillance cameras inside the home of a boy who was with Grove and Heiland captured Grove pointing the red laser light of the gun at Heiland and Heiland saying, “Take your finger off the trigger.”

Police also said a two-hour FaceTime call placed by the third boy showed Grove pointing the gun at Heiland while Heiland was on the ground and shielding his face.

The boy said he heard Grove say after the shooting, “I am so sorry, K.” “K” is apparently short for “Kain.”

Witnesses also told police Grove threatened other children.

At one point, he approached two girls who he thought had his friend’s scooter. One of the girls said Grove told them he wasn’t afraid to shoot someone and would if he could.

Another witness said Grove pointed the gun at the girls as he walked away.

In 2023, Heiland’s mother said she thought the charges against Grove should be stronger.

“I think it should have been first- or second-degree murder because I feel like it was premeditated. I feel like he planned out to kill my son,” Devin Rexroth said.

She also has a question for Grove.

“I would ask him why he killed my son because I’m just not understanding why he would do that,” Rexroth said.

A San Diego woman is accused of killing a baby twin and injuring his sibling while she was babysitting in a Pittsburgh, Pennsylvania neighborhood.

Nicole Elizabeth Virzi, 29, is being held in a Pittsburgh jail without bail on charges of homicide, three counts of aggravated assault and two counts of child endangerment, according to charging documents obtained by NBC 7.

David Shrager, the woman’s defense attorney, told WPXI Virzi was changing one of the 6-week-old twins on June 15 when she noticed bruising and swelling. She told the child’s parents who took that baby to the hospital.

Virzi told her lawyer while she was alone with the other twin, the baby fell out of a bouncer, WPXI reported. The baby died in the hospital a short time later.

Doctors said the injuries weren’t consistent with a fall. The cause of death was determined to be blunt force trauma, court documents obtained by WPXI show. The surviving twin’s injuries — scratches, bruising and swelling — were obtained in Virzi’s care, the court documents allege.

Virzi denies the allegations. Her attorney said “it was purely accidental,” WPXI reported.

Shrager said Virzi was visiting the couple from California, where she was working to obtain her PhD. Records obtained by NBC 7 showed she has lived in Hillcrest for the last four years.

The gunman who shot five of his coworkers — killing two brothers and wounding three others — at a Chester industrial laundry and linen company Wednesday morning calmly walked through the facility as he fired a handgun at his victims in a “cold-blooded shooting,” Delaware County District Attorney Jack Stollsteimer said Thursday.

Wilbert Rosado-Ruiz, 61, of Chester, was charged with two counts of first-degree homicide in the deaths of brothers Leovanny Peña Peña, 30, and Giguenson Peña Peña, 26, as well as multiple counts of aggravated assault, reckless endangerment, and a firearms charge.

According to Stollsteimer, Rosado-Ruiz, an employee of Delaware County Linen since 2016, had a verbal dispute with a female coworker on the morning of the shooting. After Rosado-Ruiz walked outside to make a phone call, Stollsteimer said, security footage showed that he returned to the laundry facility, pulled the gun from his waistband, and shot the woman in the chest before calmly and “methodically” pacing the building and firing at four others, killing the Peña Peña brothers.

“I’m tired of people f— with me,” Rosado-Ruiz said before shooting a surviving victim in the back, according to the affidavit of probable cause for his arrest

He then attempted to shoot a sixth person, the affidavit said, but the gun jammed, or was out of ammunition. Investigators found two bullet casings outside the laundromat, and at least eight inside, the document said.

As Rosado-Ruiz left the building, Stollsteimer said, security footage showed him “calmly” walking toward his black Toyota Scion. When he happened upon his injured female coworker outside, he ran toward her and fired his gun at her again but missed, the district attorney said.

On Thursday, two of the surviving victims were listed in stable condition, while a third was in critical but stable condition, officials said. Stollsteimer said he did not yet know whether Rosado-Ruiz targeted his victims, including the brothers, who he said “were just there trying to work.”

“This is an incident where he walked around the factory and started shooting at people,” Stollsteimer said. “It’s mind-numbing to see it, knowing what he’s doing.”

Employees of the linen business had expressed concerns about Rosado-Ruiz in the past, Stollsteimer said, and the day before the shooting had met with company management about the man’s behavior.

When officers arrived on the frenzied scene on West Fourth Street in Chester’s West End about 8:30 a.m. Wednesday, they first found Leovanny Peña Peña lying dead outside the building’s entrance, police said. Inside, Police Commissioner Steven Gretzky said, officers found another victim and quickly applied a tourniquet to stem the flow of blood before using a laundry bin to wheel him outside for help. Continuing the search of the building, Gretzky said, police found Giguenson Peña Peña dead near the back entrance of the facility.

As Rosado-Ruiz drove away in his Scion, Gretzky said, neighbors gave police the description of the car, which helped officers to quickly arrest him near the intersection of Kane and Culhane Streets.

Rosado-Ruiz had legally purchased the handgun, a 9mm Remington R51 semi-automatic pistol, that he used “to massacre people” on Wednesday in 2018, Stollsteimer said, but did not have a license to carry it concealed, as he did at the linen business.

Several dozen employees were working at the family-owned business — which has supplied towels and linens to hotels, restaurants and other clients in the region since 1988 — when gunshots ran out, sending panicked workers bolting for the door.

“He was coming after everyone like crazy, I didn’t know where to go, but he went straight after two guys,” one shaken employee said outside the linen company in the aftermath of the shooting, as clusters of workers huddled behind crime scene tape, comforting each other.

By Thursday afternoon, there were few, if any, signs that a shooting had taken place at the business the day before.

The police tape that surrounded the building was gone, and no memorials had been set up at the scene. Only a light hum of washing machines emerged from the facility as employees returned to work.

Outside, Vincent Marsero, who owns the business, sat bleary-eyed in his truck in the parking lot, taking calls. He declined to discuss the shooting, the victims, or the alleged shooter.

After a sleepless night, Marsero said, he considered closing business for the day, but in deference to employees who he said were looking for a sense of normalcy, he decided to give workers the option to come in. Most did, he said.

“I’m the leader of this family,” said Marsero. “I’ve got to support them.”

Police in Philadelphia have announced the arrest of a woman sought after five people were struck by a Nissan Sentra in a grocery store parking lot in the Oxford Circle section of Northeast Philadelphia on Monday.

According to police, Omobolanle Paige, 45-year-old, from Northeast Philly, was arrested after she, allegedly, driver her 2015 Nissan Sentra into five people in the parking lot of a grocery store along the 6300 block of Oxford Avenue at about 1:48 p.m. on Monday afternoon.

Officials said that four women who were struck — aged 57, 45, 76 and 29 — all suffered bruises and scratches in the incident.

A 76-year-old man who was struck, police said, was unharmed.

Three of those who were struck were taken to the hospital after the incident, officials said.

Paige was apprehended on Monday after the incident. However, police said on Wednesday that Paige has been charged with six counts of attempted homicide in the incident, along with additional aggravated assault charges and related offenses.

An investigation into the incident is ongoing, officials said.

Authorities have charged a woman who they say struck five people with her car in the parking lot of a Philadelphia grocery store Monday afternoon.

Omobolanle Paige, 45, was charged with multiple crimes, including six counts each of attempt to commit criminal homicide and aggravated assault.

Investigators allege Paige was driving a Nissan Sentra when she struck four women and a man outside a store on the 6300 block of Oxford Avenue.

The victims ranged in age from 76 to 29, according to police, and three were taken to a local hospital for treatment of non-life-threatening injuries.

Paige was taken into custody at the scene.

The Dauphin County DA confirms that Cugini was released from prison Thursday after posting his $200,000 bail.

The DA also stated that while on bail, Cugini is not allowed contact with the victim or any other minor.

A York City police officer has been arrested on charges of rape and aggravated indecent assault of a 13-month-old child.

Police report that Officer Steven Kyle Cugini was arrested without incident on April 16th following an investigation led by the PSP Lykens Criminal Investigation Unit.

Pennsylvania State Police (PSP) Lykens first responded to reports of severe bruising of a 13-month-old between April 11 and April 15. This spurred an investigation into the incident in where investigators found that the victim had suffered broken bones, severe bruising, and sexual violence.

Authorities report that the child was admitted to Hershey Medical Center where their injuries were reviewed by the Dauphin County Child Abuse Team and PSP.

According to criminal complaints, the child suffered a broken tibia and fibula on her left leg and other injuries that medical professionals say is evidence of sexual abuse.

Charging documents allege that Cugini first blamed the injuries on diaper rash, a fall, and the family dog. After police questioning, he allegedly eventually admitted to police that the injuries occurred while he had been caring for the child alone.

Criminal charges were approved by Dauphin County DA’s office on April 16, leading to Cugini’s later arrest. Per police protocol, Cugini has been immediately suspended while the investigation continues.

“As everyone knows,” Commissioner Michael Muldrow states in a release, “I will always be the first to fight and advocate for our people; but they also know (1) how I feel about kids, and (2) that I hold my Officers to the highest of standards when it comes to representing this Department and engaging with the community.”
