A child accused of shooting and killing his father in their Duncannon home about a month ago had his first court hearing on Thursday.
Clayton Dietz, 11, was charged as an adult with criminal homicide for the deadly shooting, which happened Jan. 13 on the child’s birthday.
Dietz arrived at the Perry County Courthouse in New Bloomfield just after noon Thursday for a 1:30 p.m. preliminary hearing that he waived. He was handcuffed and surrounded by probation officers.
The boy appeared to be tripping over himself while appearing in court. CBS 21’s Lily Sexton was at the courthouse and overheard Dietz telling his mother that the handcuffs were hurting him.
While the family had no comment to the media, his legal representation laid out potential plans for the trial.
“My goal is going to be to try to get him into juvenile court,” said Dave Wilson, the child’s attorney.
Dietz is accused of shooting his sleeping father, 42-year-old Douglas Dietz, with a revolver he found in a safe. The child allegedly told authorities he found the keys to the gun safe while searching for his Nintendo Switch, which had been confiscated.
During an interview with troopers, Clayton’s mother said he told her, “I killed my dad. I hate myself.”
An affidavit for Clayton also explained he had a “large contusion” above his left eye and had a small cut near the middle of his lower lip.
On the day of the shooting, authorities asked Clayton what he believed would occur when he fired the revolver. He allegedly claimed he was mad and didn’t consider what would happen.
While investigators spoke with Clayton and his mother in the kitchen, a trooper also claimed to have heard Clayton say, “I killed Daddy.”
