A man has been indicted on a first-degree murder charge in the death of an Austin man who was shot and killed while parked outside a Martindale home in October 2021.

Caldwell County District Attorney Fred Weber confirmed to KXAN a grand jury met Wednesday morning and issued the indictment against Terry Turner, 65.

Turner turned himself in Oct. 22 following the death of Adil Dghoughi, 31. Dghoughi died from his injuries after being shot in the early morning hours of Oct. 11. Turner bonded out of jail the same day he turned himself in to authorities.

The Caldwell County Sheriff’s Office told KXAN as of 4 p.m. Thursday, Turner was not in custody. 

Court documents stated Turner told law enforcement he woke up in the middle of the night and saw a strange car in his driveway. That’s when Turner, according to the affidavit, ran to get his gun.

Court documents said Turner stated he chased after the car with the gun as it was reversing out of his driveway, and he shot through the driver’s side window. Turner claimed the driver, Dghoughi, pulled a gun on him as well. However, law enforcement didn’t find a gun inside the car, an Audi.

KXAN obtained Turner’s indictment, which said he “intentionally and knowingly caused the death of an individual, namely, Adil Dghoughi, by shooting [him] with a firearm.”

Dghoughi is a Moroccan national with a master’s degree. After he died, his body was taken home to Morocco. The Dghoughi family attorney told KXAN his mother traveled to Texas from Morocco to follow the investigation and pursue justice alongside Dghoughi’s brother.

The family attorney released statements on behalf of Dghoughi’s mother and brother, saying they are both “overcome with emotion over the news of the indictment.”

Dghoughi’s mother, Fatiha Haouass, said she pleaded with the district attorney to bring justice for Dghoughi by bringing an indictment against Turner.

“Today the District Attorney stood up against those who think this murder was justified and showed me and the world the honorable person he is,” Haouass continued in her statement. “I will travel home to Morocco with new trust and hope in my heart that the American system will hold Terry Turner accountable.”

Dghoughi’s brother, Othmane Dghoughi, said in his statement his brother’s life was taken “like he was nothing,” and he was “executed” by Turner.

“There are no words to describe how hard it has been,” Othmane continued in his statement. “In my darkest moments, I cried because how could I face my brother’s grave if I allowed his life to be disrespected and diminished by law enforcement who believed Turner’s lies? Now, I will take my mom home to Morocco and I can visit my brother’s grave to tell him that we are one step closer to getting justice.”

Turner’s first court appearance should be in 30 to 45 days, Weber said.

A woman from Oak Cliff admitted to convincing her boyfriend to shoot and kill her husband and has plead guilty to orchestrating the murder.

It was a year ago this month when prosecutors charged Jennifer Lynne Faith with obstruction of justice. Later that year they added a murder-for-hire charge, an offense that carries a potential death sentence.

Faith, 49, plead guilty on February 7, 2022. In return for her plea, prosecutors agreed to drop the obstruction charge and to recommend a sentence of life imprisonment.

“Jennifer Faith’s cold-blooded plot to murder her husband was made all the more heinous by the way she behaved after his death. Even as she wept for her late husband on TV, Ms. Faith was corresponding with his murderer, plotting about how to cover up their crime,” said U.S. Attorney Chad Meacham.

According to plea papers, Faith admitted that her boyfriend, Darrin Lopez, 49, gunned down her husband, American Airlines technology director Jamie Faith, in Oct. of 2020 in front of his home in Oak Cliff.

Faith admitted she knew Lopez – whom she called her “one and only love” – had suffered a traumatic brain injury while serving in the Army in Iraq, leaving him disabled. Both before and after the murder, she sent Lopez money and gifts, and even gave him two credit cards which she paid off using the proceeds of a “Support Jennifer Faith” GoFundMe fundraiser launched in the wake of her husband’s death.

She also admitted that before the murder, she used two phony email accounts to correspond with Lopez, assuming the identities of her own husband and one of her friends in order to falsely convince Lopez that her husband was physically and sexually abusing her. (In plea papers, Faith admitted no such abuse ever occurred.)

Seven months into her relationship with Lopez, Jennifer Faith left her home with her husband to walk their dog. One minute into their walk, Lopez – who allegedly drove from his home in Tennessee, to the Faiths’ home in Dallas, where he laid in wait – allegedly shot Jamie Faith seven times before fleeing in his black pickup.

An 18-year-old Rapid City man has been sentenced to 40 years in state prison for a fatal shooting in 2018.

A judge Monday sentenced Ronald Black Cloud in the death of 43-year-old Nathan Graham. Black Cloud was found guilty last October of second-degree murder for shooting Graham in the head, the Rapid City Journal reported.

Black Cloud was sentenced under a set of rules that prohibit minors from being sent to prison for life without a chance of parole. He was 14 when the crime was committed.

According to Pennington County State’s Attorney Mark Vargo, Black Cloud cannot be given a life sentence without parole due to a series of U.S. Supreme Court rulings that indicated how minors charged as adults can be sentenced. South Dakota state law has changed to align with these rulings.

Black Cloud will receive about 3 1/2 years of credit for time he has spent in the county jail.

Ross Johnson, who told Black Cloud to shoot Graham, was sentenced to 20 years in prison in last June after pleading guilty to aggravated assault and being an accessory to second-degree murder.

teenager accused of murder who has been incarcerated since August 2018 will likely remain in jail after a judge set his bond at $500,000 cash-only.

Ronald Black Cloud, wearing a navy blue scrub-like outfit with his hands cuffed in front of him, made his first appearance in adult court on Wednesday morning at the Pennington County Courthouse.

Black Cloud was 14 when he was charged with second-degree murder in juvenile court for the Aug. 17, 2018, fatal shooting of 43-year-old Nathan Graham. Graham, a father who owned a construction company and planned to hire troubled teens and adults with felonies, died the next day.

Prosecutors argued during a closed-door transfer hearing in December that Black Cloud, now 17, should be tried in adult court. Judge Matt Brown agreed.

Ross Johnson, now 19, was 17 when he was charged with aiding and abetting second-degree murder as well as aggravated assault in the case. State law says minors who are 16 or older are automatically charged as adults when facing serious felony charges.

Johnson originally planned to request a transfer to juvenile court but later decided to stay in adult court. He pleaded guilty to aggravated assault last week in exchange for testifying against Black Cloud if the younger teen takes his case to trial.

Prosecutor Angela Shute requested the $500,000 cash-only bond and a no contact order for Graham’s wife and stepson.

She said Black Cloud and Johnson had been shooting a handgun earlier in the day before going to Graham’s house to ask if his son wanted to spend time with them.

Shayla Colbert-Graham, Graham’s widow, previously told the Journal that Johnson was friends with their son but he wasn’t allowed to visit their house since they once caught him trying to break into the home with alcohol.

Colbert-Graham said she opened the door that day to find Johnson and Black Cloud, who she did not recognize. She said Johnson asked to see her son and she responded that he knows he’s not allowed at the house. Graham then came to the door to back her up.

Graham told the teens that they weren’t welcome at his house and a fight broke out between him and Johnson, Shute said. Johnson tossed the gun to Black Cloud who fired it twice as Graham was returning to his house. One of the shots hit Graham in the back of the head.

Johnson had told Black Cloud to shoot the gun, prosecutor Lara Roetzel previously told the Journal. Black Cloud fired once the fight was already over so there was no need to defend himself or Johnson, she said. 

An affidavit says Black Cloud told police that Johnson told him to fire the gun and a relative of Johnson said Johnson told them the same thing. Johnson told Graham when he arrived that he had a gun and would shoot everyone, the document also says.

Shute said her bond request was needed due to the serious nature of the offense. She did not comment on whether Black Cloud was a flight risk or danger to others.

Defense lawyer Joanna Lawler requested a “reasonable” bond but not a specific amount.

She said Black Cloud turned himself in to police, has already been detained for a long time, and is not a flight risk since he has supportive family members, some of whom attended the court hearing.

Magistrate Judge Todd Hyronimus agreed with the requests for the $500,000 cash-only bond and no contact orders.

A relative blew Black Cloud a kiss before deputies walked him away.

Black Cloud will continue to be detained at the juvenile jail until he is 18. Johnson, who is detained at the adult jail, could be sentenced up to 15 years in prison during his hearing on April 29.

If Black Cloud or Johnson had been convicted in juvenile court, the judge could have sentenced them to prison up until they were 21.

Adults convicted of second-degree murder face an automatic sentence of life in prison without parole. Minors charged in adult court must have the chance of parole but can be sentenced to any number of years, even as long as 261 years, the South Dakota Supreme Court ruled.

 A social media influencer in Dallas-Fort Worth scammed thousands of clients whom she sold fitness and nutrition plans to, according to a new lawsuit from the Texas Attorney General’s office.

Brittany Dawn Davis has close to one million TikTok followers and half-a-million on Instagram where she shares fitness and health tips. She also runs a YouTube channel with nearly 250,000 subscribers.

But the Texas Attorney General’s Office has filed a Deceptive Trade Practices Act lawsuit against Davis claiming she never provided any of the personal coaching promised and that the plans weren’t customized.

Cori Reali of Wisconsin spent $115 on a plan back in 2014 when Davis began selling them.

“She made it sound so easy: ‘Just reach out. I want to help all of you,’” Reali said.

The plan, though, didn’t have her name on it, and Reali said she never received specific feedback. Instead, she gained nine pounds after two weeks.

“The red flags started to go up,” Reali said. “I was not individualized. I was not part of this ‘Team Brittany Dawn.’ It set me back. It actually pushed me back into my eating disorder.”

When complaints started in 2019, Davis posted videos saying her customer service team was refunding clients. She also apologized on Good Morning America, admitting she had asked clients she refunded to sign non-disclosure agreements and that she deleted comments on her social media channels from people who called out her business practices.

“I jumped into an industry that had no instruction manual,” Davis said in 2019. “I’m basically going through uncharted territory, and I’m doing the best that I can to the best of my ability.”

Reali said she doesn’t buy that.

“You clearly are not sorry, and you need to be held accountable,” Reali told WFAA on Monday. “She literally just took the money and ran with it.”

Reali filed a complaint with the attorney general’s consumer complaint division in 2019, but never heard anything – until the office reached out last week after filing the case.

“I’m happy that there’s some progress to shine a light on her and her practices because maybe, just maybe, people will connect that it’s the same person,” Reali said.

The suit from the state attorney general’s office claimed, in one instance, two clients with a 140-pound weight difference discovered their recommended calorie intake was only 60 calories different. Brittany Dawn Davis also allegedly provided plans designed for weight loss to clients who were trying to gain weight.

WFAA attempted to contact Davis multiple times for a comment, but we did not get a response.

At least 14 customers who asked for refunds mentioned an eating disorder, according to the lawsuit.

Meanwhile, Davis also allegedly charged a shipping fee for plans, even though they were emailed. The plans ranged from $92 to $300.

The attorney general’s office is asking for between $250,000 and $1 million.

“I’m sorry for anyone who feels hurt or scammed,” Davis said in a 2019 video posted to her channel.

The influencer has continued to post content online. 

In 2020, she received more than $20,000 in forgivable paycheck protection loan money for her business.

After the issues with her health program, she pivoted from fitness to spirituality content and created the account @SheLivesFreed. Davis’ new spirituality program plans to host a one-day retreat in Fort Worth in April for $125 per person.

Reali slammed that move, too, calling it “disgusting.” 

“It’s just another scam,” she accused.

A 17-year-old boy was arrested Monday and charged with murder for allegedly shooting his ex-girlfriend 22 times as she walked her dog in a Houston park last week, authorities said.

Diamond Alvarez, 16, was lured to the park last Tuesday after she received a text message from the suspect, Frank Deleon Jr., asking that she meet him there, the victim’s mother Anna Machado said.

Soon after, Alvarez’s family heard the gunfire from their house and rushed to the nearby green space when their dog, Peanut, returned home alone, relatives said.

The family found Alvarez’s body and the mother tried to revive her daughter by performing CPR, but it was too late.

Police said the teen couple’s relationship ended after Alvarez learned Deleon was cheating on her.

Machado said her daughter and her alleged killer dated “on and off” for about a year.

“My daughter was always crying about him,” the mother said.

Machado said she visited a makeshift memorial honoring her daughter after learning of the arrest in the case.

“I went up over there again, crying and said: ’Baby you have justice. It’s not done yet. It’s not over yet. But at least we know a name,’” she said.

Deleon was being held in Harris County Jail and prosecutors are seeking a $250,000 bond.

But Machado wants the suspect held without bond.

“He doesn’t even deserve a high bond. He executed my daughter,” the mother said.

The 17-year-old boyfriend of a teen girl who was shot and killed in southwest Houston has been released from jail after he was arrested for her murder.

Frank Deleon Jr., 17, posted his $250,000 bond Wednesday morning, according to court records. He’s charged with the murder of 15-year-old Diamond Alvarez.

Family members heard gunshots on Jan. 11 around 9:30 p.m. and grew worried because they knew Alvarez was outside, walking her dog named “Peanut.”

Her mother went outside and found her daughter shot 22 times in the 15400 block of Park Manor near Markwood Lane in an open greenspace, just a couple blocks from their home.

Police said Alvarez’s gunshot wounds were consistent with her laying on her back on the ground at the time of her murder. Numerous shell casings were found around her body.

According to Houston police, Deleon was simultaneously in a romantic relationship with Alvarez and another girl.

When Alvarez learned about the other relationship, she went to meet Deleon in the neighborhood. That’s when he shot her multiple times, police said.

Deleon was arrested Monday night after detectives worked with the community to track down witnesses and leads, HPD said.

In court, prosecutors said that when officers arrested Deleon, a suitcase was found in his room, packed with enough belongings for more than an overnight trip.

When prosecutors requested his $250,000 bond, they said there were concerns that Deleon would be violent against Alvarez’s family and retaliate.

According to family members, Deleon was violent against Alvarez in the past, including punching her in the face and pointing a gun at her.

The couple was together for six or seven months, and the relationship had recently ended, the prosecutor said in court.

Prosecutors said that recently, Alvarez saw Deleon with another girl at a quinceañera, and that made her mad.

Investigators said Deleon had been involved with the other girl for a couple years, and begged Alvarez not to tell anyone he and Alvarez had been seeing each other, sparking an argument.

That’s when he reportedly asked Alvarez to meet him in the neighborhood to talk.

When he was arrested, prosecutors said Deleon told police that Alvarez was stalking his new girlfriend, which caused her to break up with him. His new girlfriend reportedly told Deleon to leave her alone on the night of the murder and blocked his calls.

Police said Deleon lied to them when he was arrested and said he didn’t meet up with Alvarez and hadn’t seen her, despite surveillance video and screenshots with evidence of the encounter.

Under his bond conditions, Deleon cannot have contact with anyone involved with the case, including the other alleged girlfriend, any witnesses or their family members. He was granted house arrest with a GPS monitor.

Deleon’s parents appeared with him in court Wednesday, where the judge reiterated that if it is discovered he is not living at their home, his bond will be revoked.

Deleon is scheduled to appear in court again on March 9.
