Frank Deleon Jr Case

Chaos filled the courtroom Tuesday morning after a murder suspect pleaded guilty to killing his teenage girlfriend last year.

Frank DeLeon Jr., 19, agreed to spend 45 years in prison for the January 2022 murder of Diamond Alvarez, who officials say was 16 years old at the time.

DeLeon was out on bond while the case made its way through the courts. The trial was supposed to start Monday, but he did not show up after defense attorneys said he was involved in a car accident on his way to the courthouse and had to go to the hospital.

Because he was not in court Monday, an arrest warrant was issued and DeLeon was taken into custody later that day. He appeared in court Tuesday morning shackled with his arm in a sling.

Moments after Anna Machado, Diamond’s mother, gave an impact statement to the court on Tuesday, she and another family member rushed toward DeLeon before being restrained.

ABC13 cameras were rolling when the trouble started just after Diamond’s mother, Anna Machado, gave a victim’s impact statement on the stand. In her comments, she called DeLeon a monster, saying his mother, who was in the gallery, had raised him to be that way.

After that, Machado and another family member rushed toward DeLeon before being restrained by court officials.

The fight lasted for a few minutes before order was restored and the courtroom cleared.

During a press conference after the hearing, the district attorney did not take questions about the fighting, just detailing what’s next in the case.

Machado, on the other hand, apologized for her actions during court. Family members said they were satisfied with the 45 years.

On Thursday, there will be a formal sentencing and Diamond’s aunt is planned to give an impact statement.

DeLeon will not be eligible for parole for at least 22 and a half years.

A US landlord was charged with murder and hate crimes Sunday after allegedly stabbing a Muslim woman and six-year-old boy dozens of times in an attack that police linked to the war between Israel and Hamas.

The child, who was stabbed 26 times, died at hospital, but the 32-year-old woman, believed to be his mother, is expected to survive the “heinous” Saturday attack, according to a statement from the Will County sheriff’s office in Illinois.

“Detectives were able to determine that both victims in this brutal attack were targeted by the suspect due to them being Muslim and the on-going Middle Eastern conflict involving Hamas and the Israelis,” said the statement, which located the killing about 40 miles (64 kilometers) west of Chicago.

The sheriff’s office did not give further details or the victims’ nationality, but the Chicago office of the Council on American-Islamic Relations (CAIR) described the child as Palestinian-American.

Authorities said the woman managed to call 911 as she fought off the landlord, named by the sheriff’s office as 71-year-old Joseph Czuba.

“Deputies located two victims inside the residence in a bedroom. Both victims had multiple stab wounds to their chest, torso, and upper extremities,” the sheriff’s statement said.

A serrated military-style knife with a seven-inch blade was pulled from the boy’s abdomen during the autopsy, the statement said.

When police arrived they found Czuba sitting on the ground near the driveway of the residence with a laceration on his forehead. He was taken to hospital for treatment before being charged with murder, attempted murder, and two counts of hate crimes.

“He knocked on the door and attempted to choke her, and said, ‘you Muslims’ must die,” Ahmed Rehab, head of CAIR’s Chicago office, told reporters, citing text messages sent by the woman to the murdered boy’s father from her hospital bed.

The attack was “our worst nightmare,” CAIR said in a statement.

US President Joe Biden condemned the killing of the boy as a “horrific act of hate”, after authorities charged the man with murder and hate crimes for an attack allegedly linked to the war between Israel and Hamas.

Israel declared war on Hamas last Sunday, a day after waves of the Hamas fighters broke through the heavily fortified border and shot, stabbed and burned to death more than 1,400 people, most of them civilians.

The subsequent relentless bombing has flattened neighborhoods and left at least 2,670 people dead in the Gaza Strip, the majority ordinary Palestinians.

Jedidiah Murphy Executed In Texas

Jedidiah Murphy execution

Jedidiah Murphy was execute by the State of Texas for the carjacking of an eighty year old woman

According to court documents Jedidiah Murphy would carjack the elderly woman, Bertie Lee Cunningham, and forced her at gunpoint to drive to a remote location. Once there Jedidiah Murphy would force the woman into the trunk of the car. Jedidiah would then drive to another location where Bertie Lee Cunningham would be murdered

Jedidiah Murphy would be arrested, convicted and sentenced to death

Jedidiah Murphy would be executed by lethal injection on October 10 2023

Jedidiah Murphy Execution

A Texas man who unsuccessfully challenged the safety of the state’s lethal injection drugs and raised questions about evidence used to persuade a jury to sentence him to death for killing an elderly woman decades ago was executed late Tuesday.

Jedidiah Murphy, 48, was pronounced dead after an injection at the state penitentiary in Huntsville for the October 2000 fatal shooting of 80-year-old Bertie Lee Cunningham of the Dallas suburb of Garland. Cunningham was killed during a carjacking.

“To the family of the victim, I sincerely apologize for all of it,” Murphy said while strapped to a gurney in the Texas death chamber and after a Christian pastor, his right hand on Murphy’s chest, prayed for the victim’s family, Murphy’s family and friends and the inmate.

“I hope this helps, if possible, give you closure,” Murphy said.

He then began a lengthy recitation of Psalm 34, ending with: “The Lord redeems the soul of his servants, and none of those who trust in him shall be condemned.”

After telling the warden he was ready, Murphy turned his head toward a friend watching through a window a few feet from him, telling her, “God bless all of y’all. It’s OK. Tell my babies I love them.”

Then he shouted out: “Bella is my wife!”

As the lethal dose of pentobarbital took effect, he took two barely audible breaths and appeared to go to sleep, The pastor stood over him, his left hand over Murphy’s heart, until a physician entered the room about 20 minutes later to examine Murphy and pronounce him dead at 10:15 p.m., 25 minutes after the drug began

The execution took place hours after the U.S. Supreme Court overturned an order that had delayed the death sentence from being carried out. The high court late Tuesday also turned down another request to stay Murphy’s execution over claims the drugs he was injected with were exposed to extreme heat and smoke during a recent fire, making them unsafe and leaving him at risk of pain and suffering.

The 5th U.S. Circuit Court of Appeals on Monday had upheld a federal judge’s order from last week delaying the execution after Murphy’s lawyers filed a lawsuit seeking DNA testing of evidence presented at his 2001 trial.

But the state attorney general’s office appealed the 5th Circuit’s decision, with the Supreme Court ruling in Texas’ favor.

In their filings, Murphy’s attorneys had questioned evidence of two robberies and a kidnapping used by prosecutors to persuade jurors during the penalty phase of his trial that Murphy would be a future danger — a legal finding needed to secure a death sentence in Texas.

Murphy admitted he killed Cunningham but had long denied he committed the robberies or kidnapping. His attorneys argued these crimes were the strongest evidence prosecutors had to show Murphy would pose an ongoing threat, but that the evidence linking him to the crimes was problematic, including a questionable identification of Murphy by one of the victims.

Prosecutors had argued against the DNA testing, saying state law only allows for post-conviction testing of evidence related to guilt or innocence and not to a defendant’s sentence. They also called Murphy’s request for a stay “manipulative” and say it should have been filed years ago.

“A capital inmate who waits until the eleventh hour to raise long-available claims should not get to complain that he needs more time to litigate them,” the attorney general’s office wrote in its petition to the high court.

Prosecutors said the state presented “significant other evidence” to show Murphy was a future danger.

In upholding the execution stay, the 5th U.S. Circuit Court of Appeals had said another case before it that was brought by a different Texas death row inmate raised similar issues and it was best to wait for a ruling in that case.

Murphy had long expressed remorse for killing Cunningham.

“I wake up to my crime daily and I’ve never gone a day without sincere remorse for the hurt I’ve caused,” Murphy wrote in a message he sent earlier this year to Michael Zoosman, who had corresponded with Murphy and is co-founder of L’chaim! Jews Against the Death Penalty. Murphy is Jewish.

Murphy’s lawyers had said he also had a long history of mental illness, was abused as a child and was in and out of foster care.

Zoosman said Murphy’s repentance should have been considered in his case but “the reality is we don’t have a system that’s based on restorative justice. We have a system that’s based on retributive vengeance.”

Murphy’s lawyers late Tuesday afternoon also asked the high court to stop the execution over allegations the lethal injection drugs the state would use on him were possibly damaged during an Aug. 25 fire at the Huntsville prison unit where they were stored. The Supreme Court denied that request without comment, in line with similar rulings by a federal judge and a state appeals court.

Murphy was the sixth inmate in Texas and the 20th in the U.S. put to death this year.

Murder Database 3000 Killers Update

murder database

Well another Murder Database (MurderDB.com) update as the new site has over 3000 killers

I have been working on Teen Killers for the most part as I tend to find those particular cases more fascinating as they are still rare as compared to others. I tend to avoid cases that have to deal with gang violence as they all tend to be the same

As mentioned in the last Murder Database update all executions in the US since capital punishment was resumed in 1977 is now completed

There is a bit of difficulty in keeping the Death Row inmates section updated as for whatever the reason when a death row inmate dies of old age or his/her death sentence has been commuted to life in prison is not always new worthy and I tend to stumble on it by accident

For the last couple of months I have been getting requests on both My Crime Library and MurderDB.com for guest posts which I have not approved as they have nothing to do with crime. For the most part they have to deal with crypto currency or gambling.

Once again I would like to thank those who have been sharing the posts on Facebook or Reddit as well as those who are liking the posts. Every post on Murder Database gets automatically posted to the My Crime Library Facebook Page
