Austin Myers was just eighteen years old when he murdered a friend and was sent to Ohio death row. According to court documents Austin Myers believed that there was a ton of the money in the victims home, Justin Back. The original plan was to rob the safe in the home, however that planned quickly changed. The first time at the target home did not go well so Austin Myers and Timothy Mosley left when they realized Justin Back was home. The two then decided to murder Justin and steal the safe. There plan was to make it look like Justin had stolen the safe and left the home.

The next day Austin Myers and Timothy Mosley would return to the Back residence. Justin Back would let the two teenage killers into the home and soon after he would be attacked and stabbed over a hundred times. Austin Myers wanted to shoot the body so after Mosley went out of the home and grabbed a gun. Austin would shoot the body twice before the gun jammed on the third shot, this casing was ejected and would later be found by police. After they hid Justin Back body the two would crack open the safe to find that it contained nothing valuable.

Austin Myers was arrested the next day and attempted to blame the murder on Timothy Mosley who would basically do the same thing. In the end this teen killer would be sentenced to death and remains on Ohio Death Row. Timothy Mosley was sentenced to life in prison

A former Northmont High School student — one of the youngest on Ohio’s Death Row — is a “big step” closer to being executed in the murder of a childhood friend.

The Ohio Supreme Court, in a decision published Thursday, affirmed the death penalty for Austin Myers, 23, in the death of Justin Back, 18, at Back’s home outside Waynesville in January 2014. Investigators said someone else killed Back but said Myers instigated the crime.

The execution is scheduled for July 20, 2022.

“It’s another step,” Warren County Prosecutor David Fornshell said about the affirmation. “It’s a big step.”

Fornshell was pleased with the 7-0 ruling by the state’s highest court.

“The 7-0 decision is always something you like to see,” said Fornshell, who handled the appeal with Assistant County Prosecutor Kirsten Brandt. “That should give the public some confidence that Mr. Myers received a fair trial and a just punishment.”

Myers, of Clayton, was sentenced to death on Oct. 16, 2014, for Back’s murder during a robbery. Another Clayton man, Timothy Mosley, actually stabbed Back to death. Myers and Mosley both were 19 years old then.

Mosley received a sentence of life without parole.

Convicted killer, Austin Myers, has been denied a death sentence appeal by the U.S. Supreme Court, says Warren County Prosecutor David P. Fornshell.

Myers, along with Timothy Mosely, was convicted of killing Justin Back of Wayne Township in 2014.

Myers and Mosely both admitted to creating an elaborate plan to kill Back.

The former Northmont High School student sentenced to the death penalty for crimes involved in the murder of a childhood friend had his motion for reconsideration denied by the Ohio Supreme Court.

Austin Myers, 23, had asked the court to take another look at the case despite a 7-0 ruling on May 17 that affirmed his convictions and the imposition of the death penalty.

Myers was convicted in the death of Justin Back, 18, at Back’s home outside Waynesville in January 2014. Investigators said Timothy Mosley actually stabbed Back to death, but that Myers concocted and instigated the robbery that turned into murder.

The ruling filed Wednesday and signed by Chief Justice Maureen O’Connor read, “It is ordered by the court that the motion for reconsideration in this case is denied.”

Myers is scheduled to be put to death on July 20, 2022. The court previously denied Myers’ attorneys’ attempts to get Myers’ sentenced changed to life in prison without parole — the same sentence Mosley is serving.

Back, 18, was a 2013 Waynesville High School graduate who was going to enter the U.S. Navy in less than two weeks at the time of his death.

After Myers’ original sentencing, Back’s mother, Sandy Cates, said, “It’s bittersweet. It’s justice for Justin, but it’s never going to bring Justin back.”

Testimony showed Myers planned the crime, including acquiring septic chemicals he expected would decompose Back’s body, but that Mosley killed Back during a struggle on the floor of the kitchen after a garrote designed to choke Back to death caught on his chin.

Myers and Back were friends until eighth grade, when Myers moved to Clayton. Testimony indicated Myers was the one who decided they should target Back’s home, unaware the family safe contained only $70 at the time.

Myers’ attorneys, Timothy McKenna and Roger Kirk, wrote in their motion to reconsider that the state’s highest court’s analysis “was flawed and ignored critical facts” and that Myers’ death penalty sentence “is patently unfair when the actual killer received life without parole.”

McKenna and Kirk didn’t immediately respond to a message seeking comment. Warren County Prosecutor David Fornshell didn’t return a message seeking comment but has said before that he anticipated the defense to appeal to the U.S. Supreme Court.

According to authorities Dillen Murray had previously attacked the teen on two different occasions would fatally beat the victim to death with a baseball bat over a girl that both of the teenagers were interested in. A Lake Wales teenager will face up to life in prison when he’s sentenced in April after pleading guilty to fatally beating his friend with a metal baseball bat in a dispute over a girl.

Dillen Alex Murray was 16 two years ago when he lured 15-year-old Giovanni Diaz to a wooded area near Caloosa Lake Village, the mobile home park south of Lake Wales where both boys lived, and bludgeoned him to death. He then called 911, saying he’d just beaten his friend and had left him bleeding in the woods, according to court records.

Murray was taken into custody on allegations of first-degree murder later that day – March 19, 2018 – the same day Diaz died. Diaz was beaten so severely around his face, head, chest and arms that he died less than 30 minutes after Murray had called 911, court records state. Polk County sheriff’s deputies found a bloody, dented baseball bat nearby.

 A 16-year-old Florida boy is accused of beating another teen to death with a baseball bat Monday afternoon, according to WFTV.

Dillen Murray has been charged with first-degree murder after he allegedly beat 15-year-old Giovanni Diaz to death in a wooded area in Polk County.

“A witness who was in the area saw Dillen walking out of the woods, and Dillen told the witness that he just hit his friend with a baseball bat,” a Polk County Sheriff’s Office spokesman told the station. “The witness ran into the woods and found Giovanni.”

Investigators say Murray has two previous charges of battery against Diaz in March 2016.

Murray was taken to the Juvenile Assessment Center and faces additional charges of possession of marijuana less than 20 grams and possession of drug paraphernalia.

The last year has been a year of pain and suffering for Nikki McNabb.  

Last March, her son, 15-year old Giovanni Diaz, was beaten to death with a baseball bat.

The murder happened in the Lake Wales neighborhood where the family lived. It’s also the same neighborhood where the accused killer, Dillen Murray, lives.

Murray is now 17-years old and is charged with first degree murder. He remains behind bars in the Polk County Jail awaiting trial.

But in an unusual move, and perhaps a legally questionable one, Murray has reached out to McNabb not once, but twice. McNabb says he first called her on the phone and then sent her a letter in the mail. She saved the envelope, which is postmarked from the Polk County Jail.

When Murray first called, she had to accept the charges. She says Murray tried to explain why this happened. “He’s like, ‘We were just arguing, we got into a heated altercation and it just went from there,’” McNabb recalled. “‘And the next thing I remember is realizing I’m yelling for Gio’s name and I panic and I called the cops.’”

McNabb says Murray said he would cry and express his sorrow over what happened, but other inmates were watching.

Then, she received the letter.  It’s one page written in pencil on the front and back. He claims he traded a bag of chips to another inmate for the envelope.  

McNabb has read the letter over and over again since first opening it on Feb. 19. It just doesn’t make sense.  “And that’s the reason why I keep reading this over and over,” said McNabb.  “I’m trying to figure out his way of thinking, like, what are you getting at? What are you trying to do? I’m lost.”

News Channel 8 On Your Side contacted the state attorney’s office.  A representative confirmed prosecutors are aware of the letter.  A records custodian is also working on providing a copy of the phone conversation made from the jail.

Murray closes by writing, “I’m sorry. I wish I could repeat time and bring him back.”  He also writes that he would like to keep in touch.

Yoel Munoz stood with hands in shackles, a faded yellow jumpsuit draped on his slender body, and when asked to repeat his date of birth, did so in a clear voice: April 3, 2001.

At 14 years old, Munoz is young, the first Lee County murder defendant to be born in the 21st century.

And yet, as he admitted Monday, Munoz is far from innocent. In August 2014, Munoz, then 13 years old, donned a mask and went to a Cape Coral homeless camp, where he stabbed 51-year-old Thomas Bergstrom more than a dozen times, leaving him there to die.

“It seemed like a long time,” Munoz said of the encounter. “But it was probably only like a minute.”

Seeking to balance Munoz’s youth with the severity of the crime, prosecutors and the Cape Coral teen reached a plea agreement Monday, resulting in a sentence of 25 years in prison followed by 15 years of probation. In exchange for his guilty plea, prosecutors agreed to reduce a first-degree murder charge to second-degree murder.

Munoz is expected to spend the first few years of his sentence in a juvenile justice facility, with a transport to an adult prison after turning 18.

“He understands he made the worst decision of his short life on the night in question,” Munoz’s lawyer, Ian Mann, said after the plea hearing. “Thirteen-year-olds do that. Unfortunately for him, this is the kind of decision you don’t get grounded for.”

As part of his plea, Munoz was required to recount the August 2014 night that he sneaked out of his home late at night, walked to Bergstrom’s camp, fatally stabbed him, then sneaked back into his room through a window. Investigators said Bergstrom was stabbed in his recliner, but Munoz said Monday that he attacked Bergstrom with a kitchen knife after being caught trying to steal marijuana.

“He wasn’t somebody along the lines of just a 13-year-old you would typically find on the playground,” Assistant State Attorney Andreas Gardiner said. “This is someone who had a little more experience, who was more comfortable in who he was as a kid.”

Cases of juvenile killers typically present several challenges for prosecutors as they try to craft appropriate punishments. Some defendants have received long terms of supervision but no prison time, as North Fort Myers teen Tyrese Landrum is expected to get next month in the killing of his mother, which also occurred in August 2014.

Other juveniles have received decades in prison, and Gardiner said Munoz’s term was warranted given the circumstances of the killing. He said Munoz’s case “had a little more sinister feel” than Landrum’s case, noting the two had a very different set of facts.

Munoz’s family declined to comment after the hearing. In an earlier interview, Munoz’s father described the teen, who came to the U.S. from Cuba at age 1, as thoughtful boy who loved his parents.

But available records paint a more troubling picture. One month before the killing, Munoz ran away from home, leaving behind a note that said he was addicted to marijuana and crystal meth. There were also allusions to gang affiliations, though those weren’t substantiated.

“You may get the impression of a kid who tries to look hard as maybe a defense mechanism in the groups that he socializes with,” Mann said. “But push comes to shove, he’s still 13 when all of this happened.”

Gardiner said Bergstrom’s family members, who weren’t in attendance, “were in agreement with this resolution.”

Logan Mott has been sentenced to 15 years in prison for murder of his own grandmother, the minimum sentence based on his plea agreement.

Mott pleaded guilty to second degree murder for the death of Kristina French shortly after Thanksgiving 2017.

Logan Mott, the Neptune Beach teenager who pleaded guilty to killing his grandma Kristina French nearly two years ago, was sentenced Thursday to 15 years in prison for the killing of his grandmother.

On Thursday, Judge Bruce Anderson said even though Mott killed his grandmother, he hopes the teen can one day be a successful member of the community.

In September, Mott pleaded guilty to shooting and stabbing his grandma in 2017. Anderson imposed the minimum 15-year sentence, saying evidence proves Mott didn’t plan to kill French.

He claims the killing was actually the immature reaction of an adolescent attempting to run away from a hopeless home life, where he was traumatized by his parents’ divorce and his father’s psychological abuse.

A teenager who killed his pregnant mother was found guilty of capital murder by a Galveston County jury Tuesday, according to the Galveston County Criminal District Attorney’s Office.

Chance Michael Moseley was convicted of stabbing his mother, Nita Marie Moseley, 57 times, and strangling her with an electrical cord in September 2015. His mother was 17 weeks pregnant at the time and her unborn child also died. Chance Moseley was nearly 15 years old at the time of the incident.

Moseley, who testified in his own defense, admitted to stabbing his mother 57 times and claimed he then strangled her with the electrical cord “to put her out of her misery,” according to the district attorney’s office.

Investigators said after he killed his mother, Chance Moseley showered to remove his mother’s blood, then drove to meet friends and smoke marijuana. He then drove to another friend’s house in Seguin before driving to Houston.

Chance Moseley also admitted to taking his mother’s cell phone and removing the SIM card, which prevented him from being tracked, investigators said.

Officials arrested Moseley in Houston after his mother’s body was discovered in a home in La Marque, Texas.

His attorneys argued that he did not intend to kill the unborn child as all of Nita Moseley’s stab wounds were elsewhere on her body except for her abdomen, according to a Galveston County Criminal District Attorney’s Office. They also claimed that Nita Moseley planned to abort the child.

In 2016, a juvenile court concluded that the seriousness of the offense, Moseley’s background, and the welfare of the community required that Moseley be tried as an adult.

Chance Moseley was indicted for capital murder for two reasons: he murdered more than one person — his mother and her unborn child — in the same criminal transaction and he murdered a child younger than 10 years of age, the unborn child, per the district attorney’s office.

Since Moseley was younger than 18 when he murdered his mother and the unborn child, he is not eligible for life without parole, according to the district attorney’s office. The law requires that he be considered for parole after actually serving 40 years.
