A Tarrant County grand jury indicted a Forest Hill police officer on a murder charge Thursday related to the June 2021 death of a murder suspect.

Investigators said Forest Hill police officer Logan Barr fatally shot 32-year-old Michael Lee Ross Jr. even though he posed no threat to the officer or others during a confrontation near a gas station last summer.

The shooting happened at about 5:30 a.m. on June 9 when Forest Hill police responded to a report of a woman who was fatally stabbed in the Quik Trip parking lot at 6549 Wichita Street.

Ross was identified as a suspect in the woman’s death and was found just north of the store in a creek at the bottom of an embankment.

Texas Ranger Eisenhower Upshaw viewed an officer’s body camera video of the incident and gave the following account of what happened in Barr’s arrest warrant.

Ross was standing in the creek holding a knife and refused orders to drop it.

A sergeant fired several shots from a less-than-lethal shotgun but Ross continued holding the knife. The sergeant asked Barr to also get his less-than-lethal shotgun.

Barr retrieved his regular shotgun instead

“Shotgun deployed,” Barr said on the radio.

“Shoot him,” the sergeant told Barr.

Ross was “still unsteady on his feet, with his pants down around his thighs, turning and walking away from the officers’ position,” the Ranger wrote, describing the body-cam video.

About 16 seconds later, Ross turned back around and faced the officers but was still 15-20 feet down a muddy embankment with his hands at his sides.

Barr fired two shots in “quick succession” and Ross collapsed to the ground.

After the incident, Forest Hill police said Ross was shot after he turned toward officers while holding the knife and had tried to harm himself with the knife.

But the Ranger disputed the department’s version of events.

“While watching the video, I did not observe Ross attempting to stab himself, make any verbal threats, raise the knife in a threatening manner toward the officers, attempt to climb the embankment … or make an effort to run,” the Ranger wrote. “Ross did not pose a reasonable and immediate threat.”

Barr was arrested last summer on a charge of aggravated assault by a public servant, booked into the Tarrant County jail, and released on bond about nine hours later.

The grand jury returned their indictment on Thursday.

If convicted of the first-degree felony, Logan Barr faces five to 99 years behind bars and a $10,000 fine. A trial date has not been set.

Greg Delgado Pleads Guilty In Luis Guerrero Murder

Greg Delgado

Greg Delgado has plead guilty in the Luis Guerrero murder in exchange for a lighter sentence. According to court documents Luis Guerrero was found in his vehicle after it crashed suffering from a gunshot wound. Luis Guerrero would later die from his injuries. Greg Delgado who was responsible for the murder would be involved in a shootout with police before he was arrested. Now Greg Delgado has plead guilty to murder and a host of other charges in exchange for a fifty year sentence. The family of Luis Guerrero were hoping that all of Greg Delgado charges would run consecutively however the judge made the sentences run all together or concurrent.

Greg Delgado Other News

He fired at officers after he shot and killed a man in 2020, and on Monday, Greg Anthony Delgado took a plea deal that left several in the courtroom unhappy.

On February 21, 2020, Luis Guerrero crashed his truck off Darby Blvd near Highway 90 after he was shot in the chest and abdomen by Delgado.

Two years later, both the victim and defendant’s families gathered in Judge Velia Meza’s courtroom where Delgado settled his fate with a plea deal.

“The the pleas that Mr. Delgado are voluntarily made, and I will accept all the pleas,” Meza said.

Delgado was charged with murder, aggravated assault against a public servant, attempted capital murder of a police officer, possession of a controlled substance and possession of deadly weapon in a penal institution.

Delgado pleaded no contest to murder and guilty to the latter four charges

Although Delgado pleaded no contest to murder, he was found guilty. Delgado was sentenced to 50 years in each case. However, Guerrero’s family is frustrated that the sentences will run concurrently.

“That actually made me angry,” Ashly López said. López is Guerrero’s niece. “(Delgado) never showed no emotion. He seemed, like, unbothered.”

Guerrero’s mother, Amalia Vera was also present in the courtroom. She said Delgado has caused a lot of harm, and his sentence of 50 years isn’t nearly enough.

In a press release, Bexar County District Attorney, Joe González said, “This defendant has shown he has no respect for the law. Even while he has been in jail awaiting the resolution of the charges from this one event, this defendant has shown he continues to be a threat to law enforcement and others by repeatedly being found with weapons in the jail. Our community is safer with this defendant behind bars.”

Delgado must serve at least half of his sentence before he qualifies for parole

Brandon Cervera More News

A man was arrested Thursday on alleged child abuse charges stemming from the torture and recent death of a four-year-old boy.

Brandon Cervera, 28, was booked on Injury to a Child, a first-degree felony.

According to the arrest report, a nurse at the Children’s Hospital of San Antonio called police to the emergency room on Aug. 17, 2021, after they became suspicious of the injuries sustained by 4-year-old Benjamin Cervera. The little boy was extremely thin and had multiple bruises all over his body in various stages of healing.

Benjamin passed away before police could respond, and a homicide detective was called in.

Detectives said that Benjamin was very thin and appeared to be undernourished and underweight for his age. He also only had on a disposable diaper, which detectives said was unusual for a child his age.

Brandon Cervera told investigators that the wounds on Benjamin’s body were self-inflicted. Photographs and video taken from the cell phone of a relative staying in the apartment were said to have contained evidence of Benjamin “hitting himself on the head with his hands and asking for bread.” An autopsy found that none of the injuries caused Benjamin’s death and that many of the injuries were not self-inflicted and were signs of physical abuse, according to the police report.

After obtaining a search warrant, detectives searched the apartment and found locks on the refrigerator, kitchen cabinets, pantry door and Benjamin’s bedroom door, which were meant to lock him inside the room.

More disturbing photos and videos were found on the relative’s cell phone, including a photo showing both of Benjamin’s eyes severely bruised and swollen, the child “shaking uncontrollably, crying, and begging for bread and water” and being denied that by Cervera and the other relative. Another video showed Benjamin forced to eat bread crumbs off the bathroom floor without the use of his hands. Benjamin was also forced to drink hand sanitizer and was seen “begging for water while crying and waving his hand in front of his mouth saying it was burning,” according to the arrest report.

Photos and videos also showed Benjamin’s physical deterioration leading up to his death, which was ruled that the little boy starved to death.

Cervera is being held at the Bexar County Jail in San Antonio on a $500,000 bond.

Brandn Cervera Other News

Video footage allegedly shows a 4-year-old Texas child desperately begging his father for bread and water before his death.

That father, 28-year-old Brandon Cervera was arrested on Thursday in connection with the August death of his 4-year-old son Benjamin Cervera, Fox29 in San Antonio reports. Cervera has been booked on an injury to a child charge with the intent to cause serious bodily injury, a first degree felony, according to online jail records.

Little Benjamin Cervera was brought to the emergency room of the Children’s Hospital of San Antonio in August covered in bruises, according to an arrest report obtained by Fox29. The child, who was close to his 5th birthday, was also only wearing a disposable diaper, local outlet KABB reports.

A nurse, who was immediately suspicious of the injuries as well as Benjamin’s emaciated body, called police. By the time they arrived, Benjamin was dead.

Brandon Cervera claimed that the wounds on his son’s body — which were allegedly in various stages of healing — were self-inflicted. However, an autopsy determined that the wounds were likely the result of physical abuse, according to the arrest report.

Cellphone footage taken by a family member and now in the hands of police allegedly showed the boy’s father denying the child food as the boy “shaking uncontrollably, crying, and begging for bread and water,” according to police documents obtained by KABB. Other footage allegedly shows the child being forced to “eat bread crumbs off the bathroom floor without the use of his hands” as well as being forced to drink hand sanitizer.

According to KABB, the boy was “begging for water while crying and waving his hand in front of his mouth saying it was burning” after being made to consume hand sanitizer.

Brandon’s bond has been set at $500,000, online records show. He is scheduled to appear before a judge for a preliminary hearing on March 29. It’s not clear if he has a lawyer
