The State of Texas is preparing to execute Stephen Barbee today for the murders of a mother and her son. According to court documents Stephen Barbee would murder of his ex girlfriend Lisa Underwood, 34, and her son Jayden who were murdered at their home and then their bodies would be buried in a shallow grave. Right now Stephen Barbee attorneys are fighting to get his execution stayed for religious purposes which seems to be the common ploy this year. Stephen Barbee would initially confess to the double murder but soon after recanted.

A Texas inmate seeking to stop his execution over claims of religious freedom violations and indifference to his medical needs is scheduled to die Wednesday evening for killing his pregnant ex-girlfriend and her 7-year-old son more than 17 years ago.

Stephen Barbee, 55, is scheduled to receive a lethal injection at the state penitentiary in Huntsville. He was condemned for the February 2005 deaths of Lisa Underwood, 34, and her son Jayden. Both were suffocated at their home in Fort Worth. They were later found buried in a shallow grave in nearby Denton County.

Barbee’s attorneys have asked the U.S. Supreme Court to stay his execution, arguing his religious rights are being violated because the state prison system, in the wake of a ruling by the high court on what spiritual advisers can do while in the execution chamber, did not create a written policy on the issue

In March, the U.S. Supreme Court said states must accommodate the wishes of death row inmates who want to have their faith leaders pray and touch them during their executions. Texas prison officials didn’t formally update their policy but said they would review inmates’ petitions on a case-by-case basis and would grant most reasonable requests.

Earlier this month, U.S. District Judge Kenneth Hoyt in Houston issued a preliminary injunction, saying the state could only execute Barbee after it had published a clear policy on spiritual advisers that protects an inmate’s religious rights. Last week, the 5th U.S. Circuit Court of Appeals overturned Hoyt’s injunction, saying it was overbroad.

On Tuesday, Hoyt issued a new injunction focused specifically on protecting Barbee’s rights. The Texas Attorney General’s Office immediately appealed to the 5th Circuit, which would have to make a ruling before the Supreme Court could take up the issue.

The Texas Attorney General’s Office said in a previous court filing that Barbee’s claims are moot as state prison officials are allowing his spiritual adviser to touch him and pray aloud during his execution.

Also Tuesday, Hoyt denied a separate request by Barbee’s attorneys for an execution stay over claims the inmate’s right to avoid cruel and unusual punishment would be violated. His lawyers say Barbee has physical constraints that limit the movement of his shoulders and arms and he would experience “intolerable pain and suffering” if he is executed in the normal manner with his arms outstretched on the gurney so that IV lines can be placed to deliver the lethal injection.

In a court filing from earlier this month, lawyers with the Texas Attorney General’s Office assured Hoyt that prison officials would make accommodations for Barbee and allow his arms to remain bent and if needed would find another location to place the IV lines.

On Monday, the Texas Board of Pardons and Paroles unanimously declined to commute Barbee’s death sentence to a lesser penalty or to grant a four-month reprieve.

Prosecutors said Barbee killed his ex-girlfriend and her son because he didn’t want his wife to know Underwood was seven months pregnant, presumably by him. DNA evidence later revealed Barbee wasn’t the father. Underwood owned a Fort Worth bagel shop, which was named after her son. She and her son were reported missing after failing to show up at a baby shower.

Barbee confessed to police he killed Underwood and her son but later recanted. Barbee said the confession was coerced and has since maintained he is innocent and was framed by his business partner.

His trial, including sentencing, took less than three days to complete in February 2006.

Barbee is set to receive a lethal injection on the same day as Arizona plans to execute Murray Hoope r for killing two people during a home robbery in Phoenix on New Year’s Eve 1980. Hooper is set to be executed at 11 a.m. CST on Wednesday.

If Barbee is executed, he would be the fifth inmate put to death this year in Texas. He is the last inmate scheduled for execution this year in the state

A Texas inmate who killed his pregnant ex-girlfriend and her 7-year-old son more than 17 years ago was executed on Wednesday, after courts rejected his appeals over claims of religious freedom violations and indifference to his medical needs.

Stephen Barbee, 55, received a lethal injection at the state penitentiary in Huntsville. He was pronounced dead at 7:35 p.m., 26 minutes after a fatal dose of pentobarbital began flowing into his body.

Barbee had been condemned for the February 2005 deaths of Lisa Underwood, 34, and her son Jayden. Both were suffocated at their home in Fort Worth. They were later found buried in a shallow grave in nearby Denton County.

In his final statement, Barbee talked about his faith in God and hoped this would not be a sad moment for his family and friends. He did not mention Underwood or her son and did not look in the direction of his victims’ family and friends, who watched from a viewing room and locked arms with one another during the execution.

“I’m ready warden. Send me home,” Barbee said, as he cried. “I just want everyone to have peace in their hearts.”

Barbee received a lethal injection on the same day that Arizona executed Murray Hooper for killing two people during a home robbery in Phoenix on New Year’s Eve 1980. Hooper received a lethal injection Wednesday morning.

The executions come despite declining support in recent years for the death penalty across all political parties. About 6 in 10 Americans favor the death penalty, according to the General Social Survey, a major trends survey conducted by NORC at the University of Chicago. While a majority continue to express support for the death penalty, the share has declined steadily since the 1990s, when nearly three-quarters were in favor.

Barbee was the fifth inmate put to death this year in Texas. He was the last inmate scheduled for execution this year in the state.

So far, 15 people, including Barbee, have been executed across the U.S. in 2022, all by lethal injection. This year’s total number of U.S. executions is already higher than last year’s 11, which was the lowest in more than three decades.

Two more executions in the U.S. are scheduled for Thursday — one in Alabama and one in Oklahoma.

 A Bowie County jury Wednesday returned a sentence of death for convicted murderer Taylor Parker.

The jury in New Boston deliberated just over 90 minutes before returning her sentence.

In her closing statement, prosecutor Kelley Crisp brought tears to many eyes sitting in the gallery.

Parker, 29, was charged in the Oct. 9, 2020 death of Reagan Hancock, 21, and cutting her unborn baby from her uterus who also died.

Crisp, without warning, displayed a graphic picture of Hancock brutally murdered and cut open body lying in hers and her baby’s blood while gasps could be heard in the courtroom.

Defense Attorney Jeff Harrelson drove home the point to the jury that Parker was human, she was flawed, but still a human.

The trial and sentencing phase lasted 49 days, including 25 days of testimony, 142 witnesses, some twice, and over 100 pieces of evidence.

Judge John Tidwell order Parker be transferred to death row at the Mountain View Correctional Unit in the small Texas town of Gatesville.

Jurors deliberated about an hour and 15 minutes Wednesday before returning with the verdict. Jurors could have given Parker a sentence of life in prison without parole.

On Oct. 3, a jury of six men and six women found Parker, 29, guilty in the October 2020 killing of Reagan Hancock, 21, who was about 35 weeks pregnant, and cutting her baby out of the womb. The baby also died. The punishment phase of the trial began Oct. 12.

A man was sentenced to death on Wednesday for the fatal 2019 shooting of a law enforcement officer who was the first Sikh deputy in his Texas agency.

A Harris county jury deliberated for about 35 minutes before returning the death sentence for Robert Solis, 50, after convicting him of capital murder on 17 October in Harris county sheriff’s deputy Sandeep Dhaliwal’s killing.

According to trial evidence, Solis shot the 42-year-old deputy multiple times during a 2019 traffic stop in a residential cul-de-sac 18 miles (29km) north-west of Houston. Dhaliwal was returning to his patrol car when Solis shot him from behind.

“The defendant executed a uniformed deputy by shooting him in cold blood in broad daylight. That makes him the worst of the worst, which is why we asked jurors to sentence him to death,” Harris county district attorney Kim Ogg, a Democrat, said in a statement.

Solis represented himself in the trial after firing his three defense attorneys.

Prosecutors had told jurors that Solis had a lengthy criminal record of robberies and sexual predation leading up to Dhaliwal’s killing.

Assistant district attorney Katie Warren, who prosecuted the case, said in a statement on Wednesday that Dhaliwal was not just a trailblazer in the law enforcement community but also an exceptional officer.

“Deputy Dhaliwal was a pillar of this community, and when it came to law enforcement, he set the bar,” Warren said. “His loss is a loss that every single one of us feels. We’re glad today that this jury was able to give justice.”

Amanda Guidry Gets 80 Years For Daughters Death

Amanda Guidry has been sentenced to eighty years in prison for injury to a child that led to the death of four year old Breonna Loftin. According to court documents Amanda Guidry and her boyfriend Jason Delacerda would abuse the four year old girl over a undisclosed amount of time that left the child with broken bones, bruises, cuts and other injuries that led to her death. Jason Delacerda was convicted of murder back in 2018 and would be sentenced to death and remains on Texas Death Row. The prosecutors were not seeking the death penalty in the Amanda Guidry case so the charges were dropped from capital murder to injury to a child.

A Hardin County Jury has decided on an 80 year sentence for Amanda Guidry after convicting her of Injury to a Child in the 2011 death of her 4-year-old daughter, Breonna Loftin. The jury in Judge Steven Thomas’ courtroom began deliberating her punishment at about 3:00 Tuesday afternoon and returned with the decision shortly after 9:00 Tuesday night. She faced up to life in prison.

The jury convicted Guidry of Injury to a Child on Friday, August 26th. She had been charged with Capital Murder, but prosecutors weren’t seeking the death penalty if she’d been convicted on that charge.

Guidry’s boyfriend, Jason Delacerda, was sentenced to death in 2018. Prosecutors say that both took part in causing injuries to Breonna.

According to doctors, the little girl suffered blunt force trauma to the head, broken bones, bruises, and burns. Investigators say the abuse had gone on for some time prior to her death.

Prosecutors claimed that Melissa Lucio severely beat the child causing her death however Lucio has always claimed that the little girl fell down a flight of stairs. What complicated the case is that Melissa Lucio would make a full confession to the murder however Lucio would later claim that the confession was forced. The Texas Court of Criminal Appeals has ordered a district court to consider new evidence in the case of Melissa Lucio and the death of her daughter Mariah. Luciois on death row for her daughter’s death and was scheduled to be executed on April 27.

In a statement following the announcement, Lucio thanked those who have supported her fight for clemency.

“I thank God for my life,” Lucio said. “I am grateful the Court has given me the chance to live and prove my innocence. Mariah is in my heart today and always. I am grateful to have more days to be a mother to my children and a grandmother to my grandchildren.”

Lucio was sentenced in 2007 for the death of her 2-year-old daughter, one of Lucio’s 14 children.

Her lawyers say new evidence shows that the cause of her daughter’s injuries and subsequent death were caused by a fall down a steep staircase outside their apartment in Harlingen, Texas.

They say Lucio was coerced into a false confession after hours of intense police interrogations.

A supplementary filing submitted by Lucio’s attorneys asserts that the conviction was based on a false confession and false or poor testimony from medical examiners and specialists. They are asking the court to withdraw its order setting Lucio’s execution date.

The filing states that there is “overwhelming evidence that the judgment this Court set for execution on April 27, 2022, represents a miscarriage of justice.”

Lucio had said she is “at peace” regardless of the decision, according to a recently released statement.

“Either way I will get my freedom soon,” the statement read. “I will go home to my family or go to heaven. If I get a new trial, I am ready for the fight. I am not the same person I was in that interrogation room. I would stand up for my rights today. I want other survivors of domestic violence and assault to stand up for their rights too.”

In the days leading up to Lucio’s clemency hearing, political and social justice figures held rallies and prayer vigils to protest her death sentence.

State lawmakers including Reps. Joe Moody, Rafael Anchia, Alex Dominguez, Sen. Eddie Lucio Jr. and more met with Lucio in early April to join the fight.

“Melissa Lucio checked all the boxes of the ideal culprit, right? She is a little Latina mom with too many children, with a drug addiction,” Sabrina Van Tassel, the director of the documentary “The State of Texas Vs. Melissa,” said at a press conference Sunday.

“After a three-year investigation, I’m here to tell you that she’s not … The world’s not going to be a better place if Melissa Lucio is executed tomorrow,” Van Tessel said.

Lucio’s children have also issued a plea to Texas Gov. Greg Abbott to grant their mother clemency.

“She’s more worried about her kids than anything,” Bobby Alvarez, Lucio’s son, said in an interview with ABC station KVUE in Austin, Texas.

On Monday, a petition delivery and prayer vigil will be held outside Abbott’s office at the Texas State Capitol, as protesters await action from the state district attorney, the Texas Board of Pardons & Paroles or Abbott.

Celebrity Kim Kardashian has also spoken out against the planned execution online.

“So heartbreaking to read this letter from Melissa Lucio’s children begging for the state not to kill their mother,” she wrote. “There are so many unresolved questions surrounding this case and the evidence that was used to convict her.”

If Lucio is executed, she would be the first Latina to be put to death by Texas and the first woman to be executed by the state since 2014.
