Malcolm Nelson is an alleged killer from Florida who has been charged with the murder of a three month old infant

According to police reports Malcolm Nelson allegedly shook the three month old infant causing horrific injuries that saw the child on life support for the last three years. Now that the life support has been taken away the child would pass away.

Malcolm Nelson was initially charged with aggravated child abuse to which he would plead no contest to. However with the child now passing away the prosecutors intends to charge him with murder.

The child victim in a 2023 shaken baby case passed away this morning at the age of 3 1/2 while under hospice care at home.

The child never made progress toward regaining brain function following the abuse he endured at the age of 3 months in 2023.

Today, the Medical Examiner’s Office took custody of his body for an autopsy.

Although the defendant, Malcolm Nelson, pleaded no contest to aggravated child abuse and was sentenced in June of last year, Sheriff Mike Chitwood announced VSO intends on pursuing upgraded charges if the death is determined to be a homicide based on the autopsy results and a thorough review of medical records.

This case remains active in consultation with the Medical Examiner and State Attorney’s Office.

An Orlando man is in custody on a charge of aggravated child abuse after doctors discovered his infant son had severe brain injuries consistent with abuse from shaking.

Malcolm Nelson, 32 (DOB 8/28/1991), could face an upgraded charge if the infant doesn’t recover from his injuries. The baby was left unresponsive and on life support following his initial admission to the hospital in January.

Detectives were notified of the case on Jan. 24, the day after the 3-month-old baby was rushed to the emergency room after losing consciousness at home in Ormond Beach and going into cardiac arrest. After extensive medical evaluation and treatment, doctors determined he had several injuries and fractures that resulted from physical abuse such as shaking.

Interviews and further investigation revealed that Nelson had shaken the infant in the past, including the morning he became unresponsive.

Detectives obtained an arrest warrant for Nelson last week and arrested him in Orlando. He was transported from the Orange County Jail over to the Volusia County Branch Jail on Tuesday afternoon and is being held on $150,000 bond.

The baby, now 11 months old, remains on life support.

A child involved in a 2023 shaken baby case in Volusia County has passed away, leading authorities to think about increasing the charges against the man previously convicted in connection with the case.

The 3-month-old child with severe brain injuries died at 3-years-old during hospice care, according to the Volusia County Sheriff’s Office.

The case started in January 2023 when the infant was taken to a hospital from a home in Ormond Beach after losing responsiveness and experiencing cardiac arrest.

Doctors later found the child had numerous injuries and fractures characteristic of abuse, including trauma from violent shaking.

Investigators identified Malcolm Nelson, a 32-year-old from Orlando and the child’s father, as the suspect. Authorities reported that Nelson confessed to shaking the infant several times, including on the day the child lost consciousness.

Nelson was later arrested and ultimately pleaded no contest to aggravated child abuse. He was sentenced in June 2025.

After the child’s death, the Volusia County Medical Examiner’s Office has taken custody of the body and will perform an autopsy. Sheriff Mike Chitwood stated that investigators will review the autopsy results and medical records to decide if the death is considered a homicide.

If so, officials say they intend to pursue upgraded charges against Nelson.
